hi! My husband and i just got married on jan. 9 of this year. I've been in the US for 2 years now under an A-3 visa. My visa has expired for 6 months but my I-94 is still valid until 2011. But i am still currently in status in the state department's record because my employer is still in the country until Aug of this year. We have not done anything yet with regards to filing for AOS. I have not changed my last name either. He lives in Maryland while i'm a DC resident.

So my questions are:

1) do i have to change my last name before i file? I have scheduled a road test in DC this Feb 4. If was thinking whether to wait for that before i file or just get another Learner's permit in MD. But i'm not sure if i could with my current status. But then i have to change my address because i now live with him in MD. And if i change my last name, what else would i have to change? my passport? I want to use his last name. I'm just worried that it might complicate some things. I don't have any idea.

2) Do i have to fulfill I-693 now so i could file it along with the I-130, I-485, and others? Or should i wait until they send me a notice to have it done?

3) Do we send out the supplementary documents along with the other forms? like our pictures together, bank account, etc

4) what other important supplementary documents we could provide to prove that the marriage is not fraud?

3) Follow the instructions, requirements for the I-130 and the I-485 are a bit different

There's nothing you can submit that will prove the marriage is not fraud, but you can give them some evidence. Even though it's not a requirement, a lot of people include extra indications of a bona fide marriage, an example being joint financial resources (bank accounts, credit cards, etc).

Jun 11, 2008 -------> AoS case transferred to CSC

Jul 05, 2008 -------> AP Approval

Jul 09, 2008 -------> EAD approval

Jul 14, 2008 -------> EAD and AP received
