Hi filipina1986,

Don't worry,

If you already have the divorce decree you can fill at ANY TIME from that moment the I-751 but with the option #2 in the form, the following was taken directly from the instrucctions on the I-751:

"Filing with a request that the joint filing requirement be waived. You may file this petition at any time after you are granted conditional resident status and before you are removed."

"If you are filing to waive the joint filing requirement because your marriage has been terminated, also submit a copy of the divorce decree or other document terminating or annulling the marriage with your petition"

So If you have your divorce decree fill and send this form immediately!!

my american husband divorced me , i still have conditional greencard for 1 year more yet. will i be able to get 10 year greencard now? i only in US for 1yr and 10 months and we only were marry 2year5month and i only got conditional greencard now for 10months. any help me?

You can file youre I751 upon receiving the decree. You just need to prove you were in a legit marriage by providing ALL docs when you were married and everything you believe would help you in processing your I-751. I'm not sure if being married for couple of years or less would be a problem as long as you can prove you did not evade any laws. Best of luck.

Well they is few things i no tell you yet. my husband said if they ask him for any information he wont help me. i never told him i can not have kids because i got problem with my ovaries and he want to have baby. after we get marry i still can not get pregnant for him after then he found the papers on my medical records telling me i got medical problem and most likely i can no have kids. Then also my husband find out i still talk with my old boyfriends on myspace and friendster and he get mad . Will they ask him for information? i hope they dont ask him. there is other problems with marriage too, we got marry in philippines and my uncle is mayor there and he do civil weddings for us but they change some dates on the papers so we dont have to wait full 10 day wait require by philippines government and we got marry in different town from where i really lived which is also not allowed by philippines law. if they ask my husband he might tell them all this. Will he be questioned if I file this on my own after we already divorce? thanks you for help me.

Filipina1986, again... if you have you divorce decree you DONT need you husband anymore, just get that decree and fill the I-751 form with the "Filing with a request that the joint filing requirement be waived" you don't even need the signature of your husband if you fill that way. But you need the divorce decree. Once you have it you can fill the form ANYTIME from that moment.

yes i know i can file myself and dont need him. but my original entry is thru bonafide marriage to him and if they ask him why we no marry no more he gonna prove me dont got bonafide marrieages to him . i want to know if maybe wen i file its on my own if they no more will ask him anythings? thats my questions. also i talked to my fren who work in embassy in phil and she says if he sends letter to uscis and tells them we break up and we no live together during our mariage and tells them wen i got my conditionaql greencards . then uscis cans revoke the aos he file on me . she told me to call ICE and ask thems so i do call thems yesterday and after 2 hours waiting and transfers i talk with investigator and he tell me this is true. if my husbands know this he will do it to me . i hope he dont knows it. thats why i ask if they will talk to him even if i file by myselfs. thanks you. i worry they will deny my 10 years greencard if they knows everythings.

if i tells them the truth i thinks they will deny me. i still haves 1 year valid greencard. i think i can waits til last minutes to file on my by myself so they dont make me go back so soon

so sorry to hear your situation. You should have a lesson learned from not telling your hubby that you can not have a baby. Just tell the truth and don't share informations unless you are asked.
