Hi everyone!

Honestly, I really dont know where to start my question. Maybe I need to explain my side and what happened to me after I arrived the state. I came here with K1 visa last July 15,2008. We got married Oct. 4, 2008 then later we found out Im pregnant. So we went on Women's and childrens hospital with no appointment at all to get a doctor. But before that interviewed me and they gave me papers and forms to be filled up and I did filled it up. She (financial adviser) asked me if I have insurance here and I told her "no, I have'nt cuz I just arrived here and I didnt filed my AOS yet" then she said dont worry we will help you. My husband only earning barely $34k annualy, since Im consider 2 plus my husband in our household which is were qualify to get the temporary public assistance. His earning is good enough for us right now but since were saving for the AOS fee were really having a hard time paying for my health insurance. The Social Service helped me cope up with this issues and Im recieving a health benefits from and were doing fine.

But when I filled up the form of i-485, part 3, it says:

2.)Have you received public assistance in the United States from any source, including the U.S.Government or any State, county, city, or municipality (other than emergency medical treatment), or are you likely to receive public assistance in the

future?

-which is big YES. I dont want to lie from them because I really did. I dont know if it consider emergency assistance. I know its temporary assistance because it expires May 31, 2009. And I dont want to be a public burden no more, as soon as I can have my work permit I really want to work I want to get off from public assistance.

My question is DOES USCIS WILL NOT HONOR ME TO GET WORKING PERMIT, AND GREEN CARD BECAUSE I RECIEVED PUBLIC ASSISTANCE? OR WILL THEY DEPORT ME FOR THIS? which I really hope not.

I would appreciate your opinion and help. And thanks for reading this post.

You do not have to have a greencard to be added to your husbands medical insurance, you could have been added from the day you got married. He has a good income more than most so I would assume he has medical insurance.

You must not lie to the USCIS about this all you can do is give them the full details for exactly what assistance you have recieved and hope for the best.

I went through the same. I heard it does not automatically gives you a denial. They just want to know and it depends on the kind of help you received. I filled out yes and attached a paper where I explained them the situation. My case is still pending so I cannot tell you the outcome of it. But good luck!

 Your husband agreed to be financially responsible for you. The government could force him to repay any public assistance you receive.

Here is a link to the USCIS web page on public charges:

This link shows that Medicaid and other programs are not considered a public charge:
