Ok so I plan on staying in Colombia for about 8 months, from June to Febuary of next year and getting married. I've already tried the K-1 route but was denied and received a 212(a)(5)(A). I wondering if I eligible to do the DCF after having been denied.

Interview Date - 8/26/2008 - (Asked for petitioner to be interviewed as well, new interview Date 9/18/2008)

Interview 2 Date - 9/18/2008 - (Case Sent to review, and not DENIED as I orignally thought)

Gave up on K1 process - 9/19/2008

Canceled K-1 Petition - 5/1/09

Married - 5/30/2009

Recieved K-1 2nd Approval (HA!) - 6/6/2009

You would be able to file but only if you are resident in Colombia for at least six months and also married. Just visiting or having a tourist type visa would not count.

Whether or not your K1 denial will matter depends on the reason for the denial. If it was simply that they did not believe the relationship was real, that is much less likely to cause much trouble with the DCF process as long as you're married, resident in Colombia, and have proof of living together. If there were other reasons, you are likely to run into the same problems again.

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

Getting a visa in Colombia as resident is not that easy, make sure you answer the 212 otherwise you will be considered having committed false visa application. also file a FOIA es[ecifically asking to see the report they sent to USA from Bogora.
