SSN Name Change Denied

My wife received her SSN several weeks ago, prior to our marriage. We recently applied to change the name on her SS card to her married name but were denied because we are within the 14-day window for expiration of the I-94. Is that proper? We just wanted to update the records at SS. Will we now have to wait until EAD to update her records? How will this affect our tax-filing this year if SS still lists her with her maiden name instead of married name? Very confused :blink:

D. PROCEDURE - SSN CARD REQUEST BY ALIEN NOT AUTHORIZED TO WORK

4. Correcting Numident Data When a Replacement Card Cannot Be Issued

If the alien does not provide evidence of work authorization or a valid

nonwork reason, explain that no replacement card can be issued.

Although a replacement card cannot be issued, the Numident can be

corrected if the alien has provided documentation supporting the change

(e.g., a name change).

If the alien provides documentation supporting the change, process the

SS-5 to update the Numident information but suppress the issuance of a

card. (suppress issuance of the card.

Go back to the office with the marriage certificate and that's all she will need if it has her age or date of birth that can be compared to her SSN record. Once the record has been corrected ask for an SSN Verification Printout. Not the same as having a card, but better than nothing.

Then once she has an EAD card, she only needs to apply for a replacement card, since the record has already been updated.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If they only want the record up date no it isn't, there is no immigration verification involved with just updating the record with the married name.
