Since you are getting your feet wet, I think others that have suggested that you read the guides on this site are right on. Read the guide for K1 and read about the affidavit of support. I followed the guide on this site to do the I129F, and my petition was approved.

What if he's bringing his own funds over... and plans on working... or if his family has money could they sponser him?? I'm divorced and have two children... I do have a good job..I work for a bank.. but I get next to nothing in child support... actually $50.00 for 2 kids!! ..Yes.. We can say LOOSER now... anyhow.. I rent my home... I don't think I would qualify (I don't think anyhow) as a sponser... so then what??.... I ask a family member on my side, or can his family sponsor him???? :wacko:

anyone know about sponsoring tho???the ins and outs??? Im sorry.. we are just bareley getting our feet wet.. jut got the packet to file the I129.... trying to get everything gathered up for that that I need... also proof of meeting... Pictures, notarized statements from family and friends that have seen us.. have video also from christmas, easter, and going to the zoo if they need more proof lol

Yes you can have a cosponsor. You need to take a breath, read the guides and familarize yourself with the process so that you can give a potential cosponsor all the information they might need. The fear you're displaying here will be removed when you arm yourself with knowledge.

This site has almost everything you'd need to learn about the process, including example forms to download (most of which have coordinating instructions).

Welcome to VJ others have suggested that you read the guides. It is very important that you do all your research as YOU TWO are going through this process and that every case is different. It is also very important when you file the petition that you keep your timeline updated at all times as it is very important in calculating the statistics on this forum and to enable members answer any future questions effectively.

the Affidavit of support has to be filled in by the person in the US sponsoring your fiance. The sponsor has to meet the financial requirements according to the poverty levels *125%.

This is the basic rundown of what is required:

1. You or another sponsor has to provide proof that you can support your fiance according to the poverty guidelines times by 125%.

2. Gather all evidence of the relationship, birth certs, passport stamps etc.

3. File the petition and send off - then wait wait wait.

4. The USC (yourself) will receive the NOA1 then wait wait wait, then you will receive NOA2, then wait wait wait, once the file has been approved it will be forwarded to NVC who will then in return send it to London consulate after doing all the checks they need to.

5. When the file is sent to London your fiance will recieve pack 3 which he needs to fill in and return, this is where the affidavit of support comes in - the USC has to send this to the fiance ready for the interview together with other documents (see guides)

6. Your fiance will have to schedue a medical and wait for an interview date. Once the date is sent to him he attends the interview and all being well he should have the visa stamped on his passport within a week.

7. Your fiance then has upto 6 months to use the visa (one time only entrance to the US) this should give ample time for him to finalise stuff here in the UK.

8. Your fiance arrives in the US - apply for a SSN two weeks after arriving in states giving enough time for his details to get on their system.

9. You have to get married within the 90 days of him entering the states, after marriage file the AOS, work permit, and advance parole if he wishes to return back to UK for a visit. He CANNOT WORK UNTIL HE GETS HIS EAD (work permit) Then wait wait wait.

After all this there is more paperwork etc to deal with but I cant tell you about that yet as I am not at that step yet.

The most important thing in going through this process is that you both have patience and to research, research, research. This process is so stressful at times that it can take over your relationship and you may argue etc but if your relatinship is strong enough to handle this process then you can handle anything.

You mentioned something about your fiance staying in UK till his son finishes college... do you have any ideas how long that will be? Are you ready to start the K1 petition now? It could take around 6 months for the process to be completed or it could take longer - again I have no information on how to bring his son over here that is for you to do some reseach on how to go about that :)

As to him bringing his own funds etc well I believe he can sponsor himself at the interview stage but again I personally dont know how, maybe another member who has done that can advice but again please for your own sanity read the guidelines, browse through the forums and timelines sections as well as the UK embassy information on peoples experiences at the interview stage. It is very vital that you do your research.

I self-sponsored going through the London Consulate instead of doing the Affadavit of Support (I emailed them first to ask if the assets I could demonstrate were enough and if the proof I intended to show would be acceptable - make sure you do this if going this route) but note that this is ONLY for the K1 stage. I think you are basically showing that you can support yourself for the 90 days from the date you enter the States until your K1 runs out.

Now we are married and I'm doing the next stage (adjustment of status), it's a different story because it refers to support for a very long time! At this point. you DO need an affadavit of support. If you, the US citizen cannot demonstrate income over 125% of the poverty line, you will need a co-sponsor who does. Can be family, friend, anyone, but must be a US citizen.

P.S. Also, I think you said your fiance's son is 17? I wonder if sponsoring him once he reaches 18 becomes a problem? Maybe someone else knows about this?

The 'who' of being a sponsor is simple: You are going to be his sponsor.

If there is you, your son and your BF in the household, that is three people; look up the Poverty Guideline to see how much your income must be to account for 3 people. Your BF's income will not factor in. (this is for after he getshere---Affidavit of Support I-864)

This is an important thing to figure out; he will not be working for his first 4-7 months in the US.

Read the Guides (please!) and these links. Don't worry about not understanding it...keep reading it. It takes several reads thru before it all starts to sink in.

Someone just sent me a PM asking me to explain how I meant 4-7 months before the foreign fiance would be working in the US. These are my observations based on, well, observing a lot of posts on the topic. :)

When the foreign fiance enters the US, they are indeed "employment authorized" by virtue of their status, for their first 90 days. That is fine and dandy, but they may not be hired by an employer without *evidence* of that authorization (EA). The evidence we are familiar with is called an EAD/Employment Authorization Document.

Only one US POE reliably gives the K-1 a stamp on their I-94 at entry, which serves as a temporary EAD--valid for only the first 90 days in the US.

The K-1 *may* apply for a Social Security number from their first day (whether or not this is a good strategy should be studied up.. everyone should read the SSA Guide here at VJ and read all posts on the topic by user mdyoung).

In the above, Perfect Storm of circumstances, a K-1 could work immediately, but only for their first 90 days. There is no way to get a 'regular' EAD within the first 90 days in the US. Why? Because the K-1 must get married and send in their application for AOS and include the I-765 for EAD. I-765 regularly takes +90 days to get approved. If the couple waits until Month 3 in the US to marry, and files the AOS as is typical (near or after the first 90 days entry), the 'real' EAD is pushed out to Month 6+. If there is an RFE on the I-485 application, all timelines for the I-765 go out the window.

There is no realiable way around the 'employment authorization gap' that is (wrongly) built into the system.

The Perfect Storm example above would be reliant upon 1-having a job waiting 2-having an understanding and flexible employer. I say this because of the minutia involved in *knowing that the I-94 EAD is a valid emp document and the employer being willing to let you work as an SSA "applicant" instead of having the physical card.

Considering everything else that goes into the relocation process, getting US documents, getting married etc, the most sensible approach is to NOT rely on the foreign fiance being employed in the US for the first 4-7 months. Planning for this period of unemployment is an important part of getting off on the right foot, IMO, as a lot of frustration and problems come from not anticipating it.

I'm happy to expand on any of this more; question away. There are also many, many threads with input from people who know more than I & I encourage you all to read back in the forums. The AOS and Working in America forums will have lots of examples of what works and what doesn't.
