someone told me that if i have a H-1 visa, and my I-485/I-130 petition is pending, i DO NOT need to file I-131, Application for Travel Document??

is this true?

There are some issues with this. Do a Google search of the Usenet newsgroup <alt.visa.us.marriage-based> for posts on the subject by Folinskyinla, or consult with an immigration attorney.

My understanding is that you are good to go........lucky you!!!!

November 22nd 2005: Received receipts for I485, I130 and I131

December 6th 2005: Received RFE for medical

December 15th 2005: Biometrics appointment

February 23rd 2006: I131 touched

February 25th 2006: I485 touched - medical has been received at Chicago Lockbox

March 31st 2006: I131 touched

April 3rd 2006: I131 touched

April 3rd 2006: I131 received!!!!

May 5th 2006: Interview notice received

June 21st 2006: Interview - APPROVED!!

May 2008: Applied to remove conditions at Nebraska service center

May 2008: forwarded to CSC

June 19th 2008: Biometrics

August 21st 2008 card production ordered - YAY California!!

What if the H-1 wants to quit his/her job? Work for another employer?

As long as the conditions under which the H-1 visa was granted are still valid (still working for the same employer, etc.), then yes, you can use your H-1 visa to travel in and out of the US. As soon as the conditions under which the H-1 visa was issued are not valid, then you must use AP to be able to reenter the US.

i have a valid H-1 which expires in 2008, and my AOS is panding.

so i guess i don't need an AP :)

Just be sure you understand that you MUST maintain your H1-B terms for this to be true. If you violate any part of your H-1 status, you become merely an AOS applicant, and would need AP.
