Hi, I have a question, I have currently been living with my fiance in Egypt for 2 years... We would like to file the K-1, do I have to be in US. to file, or can I send the paperwork to someone in America and have them send it for me? does my passport have to show that I have returned back to US.

You can mail the I-129F to the appropriate service center that has jurisdiction over your US Domicile address. You do not need to be in the USA to send the package.

Note: You will need to prove that you did not give up US domicile later at the time of visa interview, Domicile is a requirement of the affidavit of support that you need to provide at the interview.

Have you considered getting married there and filing for a DCF at the embassy there. Much faster and you end up woth a MUCH better visa.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
