Hi there, I am new to VJ and I found that it is an excellent forum to get information. A lawyer told me that my husband would need to include an I-765 for my 12 yr old son along with mine so that he won't have to file for it at a later date. We are just putting our papers together and I want to get it first the right time as I won't be using a lawyer.

I-765 is for EAD, part of adjustment of status, you posted this to "Bringing family members of US Citizens to America" which has to do with filing I-130 to get visas for other family members like parents. Perhaps this belongs in the Adjustment of Status forum.

You file I-765 if you wish to get an EAD for your son, this is a useful ID and will allow you to get an SSN for son, if he came her on a K-2, or K-4 visa.

My son and I came here on our B1/B2 visitor's visa. My visa has expired but my son's has not. I have been married 1yr and 8 months to a US citizen who is now undergoing cancer treatment. This has caused a setback in our filing. Anyway we are putting our forms together and I wanted to know if an I-765 should be filed for my 12yr old son as well. Thank you again.

There is no extra cost for filing the I-765 with a parent. I was told to file it so that I won't have to spend the money to file it separately afterwards

I would say not to file for an EAD now - He's only 12, he isn't going to legally be able to work - why spend the money?

Sorry, I didn't look at the form - with others, there is a fee for that -

If you want to file it go ahead - I guess I just don't see the point in doing additional paperwork - You should have your GC before he turns 16, and he can't work at age 12 - But I don't think it can hurt -

BTW - there is a whole Yardie section down in the regional forums - come join us!

Hey thanks for the invite, I will definately join you guys. Regarding the GC, I know that I will get it before he turns 16; I just dont want to have to pay all of $300+ for something I could have gotten at no cost. Catch u in the regional forums. Thanks again.

I would say not to file for an EAD now - He's only 12, he isn't going to legally be able to work - why spend the money?
No additional cost when EAD is based on the pending I-485. Also the EAD makes a good ID, and is required if they want to get the boy a SSN before getting green-card.
