Here goes;

I'm a month short of my 18th birthday, here in the UK finishing my last year of college and about to start jostling with paperwork for my K-1. I'm finding new things cropping up here and there and new fees etc, I figured rather than going alone i'd enlist the support of such a great community of people who have been there and know what they're talking about.

Our Situation

- The fact is i'm still 17 (even if only for a few more weeks) and I have my doubts as to whether or not that on it's own will simply cause a problem

- My Fiancée (22 years old) has had trouble with employment over the past year, but over the past 6 months or so has kept the same job and the employer seems a lot fairer than the others hence she is likely to stay there and be promoted. But still, she will have trouble proving the 125% income requirement for the affidavit.

- I need to finish my college this year in order to progress into further education a few years down the line when things get settled; so I can't travel to the US until atleast 20th June 09.

Here's where we are so far:

- We're filling out the I-129F, a G-325A (each)

- We're getting two passport photos each this week

- We're gathering evidence such as plane tickets / passport scans / photos of us together (shame I couldn't fit the 24x36" poster of us together that I made her for christmas in the mail) etc..

- We've looked through the I-134 Affidavit and are quite unsure about how she should prove her recent income as she has no bank account, but has pretty much all of her pay stubs.

Basically, we'll have no problem proving we have a genuine relationship and that we've been together in the past 2 years (1 week in oct 07, 3 weeks in march 08 and 7 weeks July/aug 08), it's jsut the paperwork that's getting me nervous and worried, I just don't want to have forgotten anything. I know we'll probably have to enlist her father as a co-sponsor for the affidavit, does this need to be done and sent with the I-129F or after an NOA?

I hope that makes sense - I'm just looking for guidance and someone to say we're on track,

We're looking to send it away in the next week or two,

The I-134 is not required at the time of filing the I-129f. It will be required when you go to interview at the US Consulate.

I am unsure of whether your age is an issue so I'll defer that to someone else, however I do believe that so long as you are legally able to marry, you are fine.

Thanks for the quick reply, the thing about me age is that as far as I am aware, in places you are not allowed to marry under 18 without parental consent. I'd defend myself by saying that I will be far gone 18 by the time I could travel, but rules are rules.

Hi Martin, WELCOME TO VJ!

Youve certainly come to the right place!

I'm no expert being relatively new to this as well but am sure some "oldies" will chip in soon :whistle:

As far as I'm aware there are no age restrictions as long as you can prove a genuine relationship, which it sounds like you can then you'll have no problems.

Pay stubs will, as far as I'm aware, be ok as well her tax return form ideally for 3 years but to be on the safe side I would enlist the help of her father as a co-sponsor if he is happy to oblige!

We put our affidavit of support in with our initial application as we needed a co-sponsor and have heard/read many posts as to whether this was actually needed .......

In terms of time scale you will be looking around 4-6 months from start to finish (ISH!!) so your date of July 09 would be reasonable and you have 6 months to enter the US once you have the visa in ya hand!

May want to hold on filing the I-129F until after 18th birthday.

In the United States, all but two states require a couple be age 18 in order to marry without parental consent. Nebraska sets the age at 19 and Mississippi at 21 at the time of this writing (May 2003). A few states will waive this requirement if there is a pregnancy involved, but the couple may still have to have court approval.

You need to be legally able to marry in the US citizen's state at the time the I-129F is filed, so you may have to attach parental consent if the laws of the US State of petitioner indicates that to be a requirement.

Worry about the I-134 later, it is needed at the visa interview, NOT when filing the I-129F.

Thanks to you too Colin & Jess, so to verify as with the information on that page, I don't need to send an affidavit with my I-129F pack? That's great... a little less paperwork might mean giving time to some schoolwork :huh:.

The list also says one passport picture of each, whereas I've read elsewhere that two are required?

Note: It is the US citizen who is sending the I-129F into VSC or CSC for the petitioner, not the beneficiary.

Shannon + Nick: I think i'm going to hold back on the I-134 as to give more time for that to be worked out, if we get notified as to be needing it i don't see why we couldn't get a few done pretty shaprish. I specifically held back until now becasue i've been looking at the processing times and the fact that the visa lasts for 6 months from issue so that I still have enough time to finish my school and hopefully travel before the end of June becasue travel prices double as of July, not that Love isn't worth the world, but when you're starting off a new life in a new country I can imagine every little helps.

(birth certificate is also required)", sponsor is in NC so that should apply. The problem I have now is what consent form, and how to have it "notarized"?

Thanks again YuandDan, and i'm well aware the US Sponsor files it. I think we're going to hold back until my birthday now just incase they decide to decline us. That way it gives us more time to gather the right sort of info in the right format and reduce the risk of getting an "RFE".

Thanks to everyone for helping, this is a great community that I'll be sticking around with for a long while to come..

More than likely the form is available in NC where marriage license would be applied for, USC could get one and send to you in the UK for your parents to sign, and get notarized.

That's a great site YuAndDan, I would never have known there was a notary close to me (I live in *the middle of nowhere*, lol..). We're going to wait til my birthday, which happens to be a monday so my present will be my fiancée taking the nicely prepared package to be posted. This also helps to keep costs down as I'm pretty sure notaries won't be low-cost, and with the exchange rate as it is, a little all of a sudden becomes a lot.

Contact the Notary, here in the states virtually all notaries do the service for FREE.

All they are doing is witnessing a signature, and verifying the ID of the person signing the form.

Notary's here are a little pricy, one close to me in Cambridgeshire was charging £60 a document. Might be a different price near you though.
