Hi, I know that this has been discussed on many threads, and people seem to be a bit down on having your fiance visit the USA while the k1 is in process. We are going to take the chance next week, and I wanted to make a checklist.

So far it seems that the following would prove ties to the homeland:

1) letter from his work that states, assuming in English?

2) his rental contract, does this have to be in english as well? What about a letter from his landlord indicating an ongoing contract?

3) I have plane tickets to Germany in December, should he have a copy of those as well as his own return ticket?

4) What else is proof that he will be going back to Germany?

How many of you have had success or failures with getting into the country on VWP while the K1 is in process?

Thanks for the help, if you can see anything else I have missed, please let me know!

January 29, Torsten receives package 3 letter from the US Consulate in Frankfurt

February 14th 2009 interview letter arrives

March 11th Interview!

March 11th Approved for Visa at Consulate! Pending Medical....

March 19th VISA IN HAND!

April 25th, arrival USA!

July3, 2009 Married in a beautiful wedding with all of our families....

Somewhere early August.... Pregnant!

August 25th, AOS filed

October 13th, Biometrics Interview.

October 31, still waiting for EAD and AP...

November 5th, EAD and AP Approval

November 6th, I485 Touched

November 7th, AP received.

November 9th, I485 Touched

December 4th, RFE mailed

December 7th RFE sent (requested marriage certificate)

December 11th 2009, RFE received and processing resumed.

December 16th, online status: Document Production or Oath Ceremony

December 16th, email stating: Current Status: Card production ordered.

December 17th, online status Decision.

December 17th, email stating: Current Status: Notice mailed welcoming the new permanent resident!

December 23rd, GREEN CARD RECEIVED!

One more question about ETSA, the new electronic advanced approval system for VWP countries? The system was turned on on August 1, 2008. So it's possible to use this to "test" whether our not he will be denied at the port. Thoughts on this, too?

My fiance came to visit last Sunday and had no problems at the border at all--he just answered their questions with the specific information requested and was sent through with no problem. We had read on here that often problems arise when people overshare with the people at passport control, so he was to the point and not overly friendly. It seemed to work.

As far as ties to his home country, he brought a letter from work saying he would be back in a week and recent copies of bank statements and utility bills (he couldn't find the copy of our lease). He also brought a copy of our petition and a letter from the priest who is going to officiate our religious ceremony, saying we have a meeting with him for a wedding scheduled months in advance. All of this was for naught, however--they never blinked an eye. Good luck!!

My fiancee came over in September through CVG airport.

She brought a letter from work stating her return date, as well as some bank statements, and also a copy of our NoA1. She said she wasn't even asked for any documents, just asked her the standard questions and waved her through.
