Hi. I am filing the AOS application for my wife (K-3) albeit a bit late. She is currently residing in the US

Her K-3 expires in December 2008.

She is planning on traveling out of the country from late November through mid-January.

So, I think I need to file the I-131 (Application for travel document). My question is, do I submit this in conjunction with the I-485 or separately? My worry is that she will not receive it (either) in time to travel in late November. Does a receipt of the AOS application suffice to travel out of the country? Does a I-131 in process enable you to travel?

One other question - Is the I-797 the NOA2 that I need to file with the I-485?

Needing an I-131 application for a K-3 is very rare..... It will be interesting to see who knows this answer.

For a K-3 an AOS I-797 receipt might be sufficient to travel outside the country but it is NOT sufficient to re-enter the country.

I only think I need the I-131 since the K-3 expires soon and I have not yet files AOS (filing today). she has already traveled out of the country as she has a multi-entry VISA, that expires in December 2008.

As for the I-797, I am wondering if this is the right document I should be sending in with my AOS application - Is I-797 the NOA2 I need to attach with my I-485
