Couldn't read the second article but it said nothing about him being denied a MOH because he was illegal. There was something about "friendly fire" in the incident marring the award.

He said that because there was some contradictory evidence, Gates instead took the extra step of asking five other individuals to review the case — a former commander of U.S. forces in Iraq, a Medal of Honor recipient, a civilian neurosurgeon who is retired from the military and two forensic pathologists who also are military retirees.

The five were given medical reports that had not been available in the initial review. They thoroughly reviewed the case again, including inspecting the evidence and re-enacting the event, Whitman said.

"Each independently recommended to the secretary that the evidence did not support the award of Medal of Honor," he said.

The Navy Cross isn't a slap in the face either and very few MOH have been given out for those serving in Iraq or Afghanistan. A lot of guys did some heroic feats but there have only been 6 MOH awarded so far so I doubt he'll get one after a review was already done.

That friendly fire incident that somehow marred the award was the act that killed him and made him a corpse and be unable to do any action afterwards.

Listen. This happens often in the historyof warfare. Something happens that lends to guilt and then the brothers in arms act in concert and say something else to alleviate the guilt they feel. In this case they were apparently trying to elavate him to a medal that showed a larger valor than he deserved. They probably never expected that the award would be viewed as a potential Medal of Honor. When it reaches that point then any questions must be thoroughly examined. This award is huge and is historic and must not be given unless it is shown it is deserved.

In my view he may not have earned the Distinguished Cross at all and if too much enquiry is undertaken it may be shown he does not and that could be tarnished and taken away. Distinguished Cross is a huge award and not to be handed out lightly.

The report found sufficient evidence existed to believe that Peralta was probably shot by a fellow Marine and that a gunshot wound to the head and injuries to the head from a grenade caused his death.

This is from the yahoo part of the report. It was also what made me question the awarding of the Medal of Honor. It also probably made someone else higher up to also question the awarding of the medal.

If he had scooped up the grenade and placed it under his body to cushion the blow then how did he get injuried to his head? Also I remember from another report I thought that it said the report that was not sent in with the initial recommendation for the award that the five man panel had showed that grenade fragments was also in his head and toward the top so a grenade under him with his body on top could not have happened the way it was noted in the recommendation.
