K-3 vs K-1 times.

Timeline

Hi,

My girlfriend is getting divorced, and the divorce will be finalised in 21 days. We're pretty impatient people and while I can file a K-1 in 21 days, we're sort of impatient to get on and get married and we're considering waiting until I'm next visiting at the beginning of August and going ahead and getting married.

Would we suffer a penalty for going for a K-3 over a K-1? I'm not sure if it takes longer to process or is considered more likely to be a scam, or something along those lines. We'd have a extra month delay by applying for the K-3 later than we could apply for the K-1, but we're going to get married as soon as I'm in the country if we apply for a K-1, not wait 90 days.

Most times the K-1 is faster. With the K-3 You are apart the whole time of the processing. Sometimes over a year. Where as the K-1 took about 3 months and now we are finnishing up all the paperwork. The big diffrence is we are finnishing all the paperwork in the states and my wife is with me. There is not a 90 day waiting period for the K-1. The 90 days is the period in which You must marry Your fiance once she comes to the states.

The time it takes for K1/K3 depends on country!!......................BUT to beable to file K3 you first have to be married,& file I-130 as you need to send a copy of the NOA1 from that !!...........here's a example of K3 in England, mine...from mailing to actual visa in passport took 112 days!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

I'm english, so it would be similar. We'll probably stick to a K-1 as impatient as we are to not have that extra months delay. Thanks to both of you for replying!

this way, we knock off the 90 days waiting and then i come back the UK and do the interview etc.

I dont know for sure, but arent the k-3s picking up speed, so the difference isnt that great.

17 aug -- TSC receives application

no NOA1, USCIS says no record....

31 oct resubmitted

09 NOV money order cashed

08 NOV NOA1 date, yey! arrived in post 14th nov

this way, we knock off the 90 days waiting and then i come back the UK and do the interview etc.

I dont know for sure, but arent the k-3s picking up speed, so the difference isnt that great.

CR1/IR1's are realy picking up speed, well the ones at California!!!

but K3 is still pretty fast!! :yes:

sorry to confuse! but you can apply for either k-1 or k-3 while the non USC is in the US on the visa waiver program.

if you wanted to marry asap, you could go on the visa waiver program, marry the first day you can and then send off the forms. then you could spend 90 days together in the US and come back to do the last stages off the k-3 in the UK.

you can still do that on the k-1 of course, go over, put in the forms and wait your 90 days before going back to the UK to do the last stages....

the 90 days rule is that a K1 beneficiary Must be married within 90 days of entering the US or they start counting overstay time.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card
