Hello everyone

i m new here

i got to the US in march 2000, my visa expired 6 months after, tried to change it to a student visa and was refused so i overstayed ...

i met my husband 2 years ago , and we got married august 21 of this year , now i m wondering if i can get any help on how to apply , we were planning to do it on our own , is it a doable idea ?

he is american , has a good job , filed for taxes last year after 3 years of non filing since he was at school and was nt working ..

what forms do we need to file ?

also important : i don t have my I94 since i sent it to the ins while i was trying to change my visa , i was stupid not to make a copy , now i only have a receipt for the mailing , and a letter of refusal of changing status .

i never had any other encounter with the ins since ...

You are going to need the I-94 to prove that you entered the country legally. You file form I-102 http://www.uscis.gov/portal/site/uscis/men...00045f3d6a1RCRD

what i understood is i have to add that form to request the I94,

is that right ?

I believe you need to first file I-102 and when you get the replacement I-94 you can then file to adjust status using I-130+I-485.
