Ok...hopefully this makes sense.

Our Conditional GC expired on May 11 (Sunday). We sent out our package express Fedex overnight on the 8th to arrive Friday the 9th. I know we shouldn't have cut it so close but we forgot about the package and time crept up on us and we ran around like crazy people. Anyways...Fedex didn't start processing our order til the 9th so overnight put it for delivery on a Saturday. They tried but there was no delivery available. So it was officially delivered 1 day late on May 12th. There was a problem with the package so it was returned rejected on the 16th to us. We fixed the problem sent it back somewhere around the 22nd and the NOA came to us dated May 29. So our GC expired the 11th and the NOA is dated the 29th. If they were to reject it as late filing would we have even gotten the NOA? Is the NOA proof that they aren't going to consider the petition late?

The reason this has all come to my mind is that we are to attend a wedding in Canada mid October. Could a big deal be made about the span of time between expiration and NOA? Should we not risk it?

Yardie, what does the NOA say? Does it say his green card is extended for another year? If so, at least the trip in October will be okay.

Otherwise, yes, they could cause some problems for you on the actual 10 year green card. But, as for that, I would not worry about it till you hear something to that effect. Cart before the horse, girlie. You know better then that!

Yeah it says that it is extended for a year. I am not worried about the 10 year card at this point. Just gonna wait to see what happens with that. Did all I could and that is that. Just worried about our trip in Oct. and if an officer would/could make a problem about the time span regardless of what the papers says.

Well, if the NOA says that your conditional resident card has been extended for one year, you're OK. For others reading this, bear in mind that acceptance of an untimely filed application is discretionary.

There is no regardless of what the paper says. IF they sent the NOA, they extending the green card from the date it expired for one year.

Yes, I agree. I am not ever suggesting you wait to send it in. I sent ours in 86 days before it was set to expire (something like that!). I think it can greatly hinder your life if you don't.

But, also, I don't think we should needlessly worry Yardie. She did what she could. I told her she may have some explaining to do as to why it was late.

I just returned from jamacia visiting my finance and I am so excited.

when i traveled to Jamaica recently, the officer did not even check anything like they did when I did my AOS, he just read the letter, scanned my passport, asked me what food i had in my suitcase (of course patties)... and sent me along my way... so i doubt you should have a problem... the problem should be when they actually start processing your application... but maybe they will look at when the package was sent and you will be safe
