Hi. This might be a silly question, but I read (somewhere, a while ago) that the approved petition has an expiration date of like 4 months or so. I got my NOA1 on 3/1 and my NOA2 on 3/9. I called the consulate at Naples today and actually spoke to a pretty helpful human being who told me my fiance' interview would be in "a few months." Granted, English isn't her first language, so maybe by "a few months" she means 8 weeks or so, but if my fiance's interview is, say, in October, wouldn't our petition's approval be expired by that time? It doesn't make sense that they would give you a date in 3 months just to tell you your petition's approval expired while you were waiting for your interview, but I figured I'd ask since so much of what Immigration does makes such little sense.

(Oh: I don't know if this would matter, but our evidence of having met in person wouldn't be anywhere near 2 years old.)

Is this something that would be a problem, or do you think it's fine so long as the consulate is processing our case and has us scheduled? I'm so annoyed at myself that I didn't think to ask this when I had the woman on the phone day :blush:

9/11/2006: Appointment with Civil Surgeon for vaccination supplement

9/18/2006: Mailed AOS and renewal EAD applications to Chicago

10/2/2006: NOA1's for AOS and EAD applications

10/13/2006: Biometrics taken

10/14/2006: NOA -- case transferred to CSC

10/30/2006: AOS approved without interview, greencard will be sent! :)

11/04/2006: Greencard arrives in the mail! :-D

... No more USCIS for two whole years! ...

Hi Karen,

I understand that the embassy automatically extend the petition once it expired so there's nothing to worry :yes: I got a reply from our consulate last time and it reads as:

"We want to assure you that while an approved fiancé(e) petition is originally valid for four months from the date of its approval, a consular officer may revalidate it for an additional four months. This revalidation is routine as long as the petitioner and beneficiary remain legally free to marry and continue to intend to do so within 90 days after the beneficiary is admitted into the United States."
