Hi guys,

I have a quick question regarding I-765 form.

A little background about me: I am currently on F-1 student visa. I just graduated with an Associate Degree and have OPT for one year. Well, my OPT is expired in August 2009. I just got married and am planning to apply for AOS soon. Well, since my current EAD card only valid for one year, I will need to apply for EAD again based on my marriage.

Well, when I fill out I-765 (based on my marriage), what box do I check when they asked condition I am applying for

Do I check under permission to accept employment OR renewal of my permission to accept employment????

I am so confused so hope you guys can help me!

Thanks guys,

If your F-1 status changes, then any other benefit derived from that status (EAD) will also expire....

The new I-765 is for a new benefit pursuant to the I-485 not a renewal of your EAD that you got from your F-1

YMMV

Thanks for the response!!

So once I send in my application for AOS, I cannot work until I get a new EAD card???

Back to my original question, so when I filed for AOS for I-765 form, I will have to check the box under permission to accept employment then, correct? Do I still have to send a copy of my current EAD or anything?
