hi everyone,

i am new here and would want to get your thoughts, my fiance and i met last april and i will be visiting her in manila this october. we are submitting our documents for the Fiance Visa on Sept (still waiting for my divorce papers) and i would like to know if it is ok for her to come visit me on december and stay while waiting for her interview schedule. She has a valid B1/B2 visa and has visited the us 3 times. i would want her to stay for like 4-5 months then go back to manila for the interview. is it ok for her to do that? would appreciate your advise!

Hi dj yu! I am in K1 and have a valid B1/B2 for ten years. While in the process, I did not risk going to the US. But I was thinking, there shouldn't be a problem. Ive been going to the US almost every year since I was 12. If my intention is to become TNT or to evade immigration laws, I could have gotten married when I was in the US and not file for K1 anymore, right? My lawyer advise me that if I want to visit my fiancee, I should call to check or ask the embassy if its ok. Hope this helps and welcome to visajourney!

January 21, 2008 - NOA1

March 16, 2008 - NOA2

August 7&9,2008 - Medical K1&K2

August 21, 2008 - Paid document verification fee (P1,300)

August 27, 2008 - Interview

September 08,2008 - Document Verification request sent to NSO

Spetember 19,2008 - Document Verification done -sent back to US Embassy Manila

November 03, 2008 - Case under review

November 26, 2008 - VISA printed

November 28, 2008 - VISA in transit

December 02, 2008- VISA IN HAND

January 12, 2009 - Arrived USA, POE Los Angeles

January 21, 2009 - Got married

January 22, 2009 - Applied for SSN

February 10, 2009 - Went to Dr. Janet Pettyjohn for form I-693

February 11, 2009 - Sent our AOS packet to Chicago

February 12, 2009 - Packet received signed for by L BOX

February 22, 2009 - Received NOA1 for AOS, EAD & AP

March 17, 2009 - Biometrics Appointment

March 21, 2009 - SSN card arrived in the mail

April 6, 2009 - took driver's license exam and passed! (written and road test)

April 10, 2009 - Repeat Biometrics Appointment

April 14,2009 - Received AP documents in the mail

April 16, 2009 - Received EAD in the mail

SEptember 4, 2009 - GREENCARD received

Wow, aren't you the lucky one! Sounds like you are legal in every way. I'd say why not, if they will grant a stay that long.

None of my business, but sounds like you are moving very quickly. Divorce not done... Wounds take time to heal.

My divorce actually was since last year...had problems with the county of not being 'recorded', so we had to re-file again, which was such as pain....ive heard that longest time for a visitor to stay in the us for vacation is 6 mos....so hopefully it'll be ok for her to stay and go back to manila for the interview...thanks for your reply.

When I went to US last August 2006, I was given 6months to stay. But that time, I only planned for a 2week vacation. Then something happened when I came back here in Philippines so after 20 days, I went back to the US again. The immigration officer was a little grumpy to me and asked why I was back in such a short time. He gave me only a month to stay and that time I needed the 6 months. (What's the diff right?) Anyway, when my I-94 or my one month was about to expire, I applied for extension and was given another 6 months to stay. So all in all, I stayed seven months (Sept 2006 to April 2007). But that's before I filed for K1 which was January of this year. And before my fiancee filed for K1, I made one more visit to him and this time, at the poe, they instructed me to go to a private room and was grilled by the immigration officer. They were not rude or anything like that but they asked a lot of questions. After 45 minutes, I was able to convince them that Im not going to stay permanently and they let me go. I only stayed for two weeks with my fiancee and now Im back here in Philippines waiting and hoping for K1 visa.

We have a similar issue, my wife has a B1/B2 US visa. We got our CR-1 case approved 2 days ago 8-8-08 and we are waiting for the interview date to be in either September or October. She is in Egypt and want's to come and visit me in the USA for a few weeks only before the interview. Based on what I heard from this forum she should call the US embassy in Cairo, Egypt to ask for permission to travel to the US.

Whether you have a valid visa to enter the US is just half the battle. The POE officer has the final say on whether you get into the Country or not. As long as you have a return ticket and can show ties to your home Country you should be all set. They have no record of your K1 unless you tell them about it. If asked any questions always tell the truth...and hope for the best. good luck.

btw... I wasn't 'legally' divorced until 3 years after my marriage was over so I think it's probably wise to hold judgement unless you know the facts.
