Hello ... here it goes!!

My fiance has an EAD that expired 7/28/08.

We are doing our AOS papers.

For the I 765 should i check the box that says renewal of EAD?

and have we applied for an EAD from USCIS before? we didnt they just gave him the ead stamp at the POE

HELP

in how to address this in the aplication =) :blink::blush:

Visa I 130 for Step Daughter

Sept 2010-- Getting documents ready. sent BC out for translation.

March 1st 2012-- Sent documents to USCIS

June 15th 2012 EMAIL OF APPROVAL !!

Dec 15th 2012 -- Interview scheduled ( 1-23-2013)

Jan 9th 2013--Medical Exam

No, you're not renewing your current EAD, you're applying for a new EAD in a different category. The stamp is a category [a][6] EAD, and with your AoS application you will be applying for a category [c][9]. On I-765 mark new EAD.

He never received an EAD (Employment Authorization Document), he probably just got a stamp at JFK allowing him to work for 90 days, but that's not the EAD you'd be applying for with the I-765.

The stamp is an EAD. It's a stamp version of a category [a][6] EAD card, just like you can get an I-551 stamp in your passport which is the same as a green card.

EAD stands for Employment Authorization Document, a stamp is not a document.

Renewal is only used when you are applying for another EAD in the same category as the one you currently hold. If your situation changes, and you become covered by another category of Title 8 CFR §274a.(12) then you are applying for a new EAD in that category (as is the case with a K1 holder going to an AoS. Any previous EAD they had as a K1 holder was under category (a)(6) and now as an AoS applicant it's under [c][9], so it's a new application. You're not renewing your (a)(6) EAD).

And in terms of a stamp, the stamp is placed on the I-94. That makes the I-94 a document proving employment authorization, or an EAD, as well as serving as the arrival and departure record. Not all EADs are cards.

Yes. Apply for a new one rather than trying to renew the existing one.
