Ladies/gents,

I am K1 Sponsor, I don't know why I can't log in as K1 Sponsor anymore. I am now CoDon.

My lawyer submitted the documents in June, now is almost August. It has been almost 2 months. My fiancee and I haven't heard a consulate's response. What is the next step that I or my lawyer can do? Please advice if you know other alternative. Thx.

You should probably give some more background about your case so that everyone can get an accurate picture of what is going on.

I said you'd best make a new topic because that other thread was so old. I didn't know you were one and the same person. You might not be able to use the same name if you've not logged into it for some time.

Anyway, I remember your case, but maybe you can highlight what happened since you last posted? You hired a lawyer obviously and sent in a new K-1 package? Have you called your lawyer to ask what's going on? Have you logged into the USCIS website to see if there is any movement on your petition? Have you received an NOA1 yet? If you haven't received notice that you petition has even been accepted for processing I'd be asking your lawyer if he's forwarded it to them.

If you're just waiting on your NOA2, and you sent your petition in June, then it hasn't been quite too months yet. There is no hard and fast rule as to when the NOA2 is processed and sent. More like 3-6 months.

I am K1 Sponsor poster. I am not waiting for NOA at all. I am waiting for the answer from my lawyer sent documents to the Consulate. Looks like the Consulate doesn't care what my lawyer submitted... Below is the email I communicate to the consulate office, not the interviewer... sucks... The consulate is threaten me to return the case since December 2007. Until now, they have done nothing...

Dear Mr. Le,

According to our records, we received more documents from your lawyer on June 3 and they was already joined with your fiancée's file. However, our records has not yet shown any changes on our consular officer's final decision on this case. Your fiancée's case is pending a return memorandum in our office. Once the case is returned, we will inform your fiancée and return all personal items submitted in support of the application to her at that time

I don't think your lawyer here is going to be able to do much as far as the HCMC consulate goes. There is a well known lawyer there that often handles matters such as these. Visit the regional threads for more info. ;)

You're very lucky if the case is still at the Consulate after all this time. Do your best to keep it there.

Im not sure about the whole lying thing. That could be what gives you the most grief of all.

The case is still there doesn't do any good. I think it should return so I can appeal or start all over again. Should I ask for the return now?

The case still being there means it's not been returned to the US with NOID. It's a good thing... it's returned to US for it's final process before being denied. Most try like he!! to keep it there if they suffer the 212.

If it were me, I'd have been on the phone with Mark Ellis a long time ago... just a suggestion from what i've read in all my time here on VJ.

In any case, I hope you can get this sorted and that you will be reunited soon.

I really think you need to contact Marc Ellis and ask him what should be happening right now. Maybe it's normal to be waiting this long? He would know for sure. Maybe because of your previous lying on the application, they're going to cross every t and dot every i!

Your case is so unusual because you lied on the application, however even when caught by the embassy, they basically said they needed more information about a bona-fide relationship. Which is what evidence I'm sure you sent in. What did Marc Ellis say your chances were?

Sorry we can't seem to help you more. Yours is a sticky case that is rightly with a lawyer. I'm sure at this point you'd just like to have some answers to know which way to proceed now! Hope you hear something soon.

Thanks. I just got an email from Marc, he is telling me to wait because they are short of stuff due to vacation time. All I have to do is wait, wait... He thinks that my case is strong enough to win because I have submitted all the evidence they asked for. Now I have no clue how long will I have to wait? another 2 to 6 months?

It's hard to say.... but, from what i've seen here on VJ, you've got the right man on the job. ;) Hopefully you will hear something soon. If he's not concerned about your dishonesty, I would say you are VERY lucky as that is normally a very serious issue.
