Hello everyone. I went to Juarez for my interview and unfortunately I wasn't attended by the nicest person in there. To make a long story short he told me he couldn't find me in the computer and that he needed more info on my case from USCIS, so he had to send for that info. So my case is put on review. I called the consulate last week and they told me that in the computer it saids that "I" didnt have all my paperwork that was needed so my case was put on review and the girl on the phone told me that would take six months for me to hear from them again. First of all, I don't know who to speak to about this so I can see if I can make the process go faster because what is in the computer is not what the paper that the consulate officer gave me says. In the paper it says that they are waiting for "files" from USCIS, and that I need to wait for them to send me another letter for my next appointment. Well that is one thing. By the way, my common law wife applied for a K1 VISA. Now, what I want to do is marry her, not in the USA( I am not in the USA). If I marry her, what do I need to file and where and how long will this take etc. Is there a webpage where I can see time frames and procedures on this... Thank you.

if there is k1 and it is denied or expired and you marry and refile your looking at prob a year

I'm confused - you have a K1 visa application in progress for yourself as the fiance of a US Citizen, but your common law wife in Juarez wants one as well?

Is the common law wife the US Citizen?

No, I guess I didn't explain myself correctly....The person who filed the K1 visa for me is an American citizen, who is also my common law wife. I have been with her since 1999 and we have kids ( american citizens ). She lives in CA and I live here in Baja, Mex. What I want to do is marry her to make it official and what I want to know is what exactly are the next steps. I have that K1 VISA in review but I want to get married better so I just want to know what is it that I need to file and how is this going to affect my K1 VISA case right now.

marriage will completely cancel a k1 and u have to start over cr1 or k3

But...California does not recognize common law marriages unless they originated in one of the states below FIRST:

STATES THAT RECOGNIZE COMMON LAW MARRIAGE:

Alabama

Colorado

Georgia (if created before 1/1/97)

Idaho (if created before 1/1/96)

Iowa

Kansas

Montana

Ohio (if created before 10/10/91)

Oklahoma (possibly only if created before 11/1/98)

Pennsylvania (if created before 9/03)

Rhode Island

South Carolina

Texas

Utah

Washington, D.C

It sounds like you might be better off working through your K1 visa problems, as otherwise you will have to start all over and will still have the K1 paperwork following you.

It sounds like they're just missing something.

If that's the case I would most certainly wait for the documents to reach the Consulate. Have your partner contact her representative to ask for assistance in this. It may also help if she calls the Consulate herself.

If you marry in Mexico instead you are looking at what is now an even longer wait than the K1 took.
