Bank Letters

Hi All, I'm one of those too nervous to do such an important thing myself and so I hired an attorney, but sometimes the directions the attorney gives me conflict with what I'm seeing on VJ. For instance, while we were waiting for the NOA2, I kept asking my attorney's assistant, "Is there anything else I should be doing, any documents I should be gathering, etc., so that we will be prepared when the NOA2 arrives?" She said, "just keep gathering evidence of your relationship, keep taking pictures, keep all receipts, etc., etc." I had asked if they wanted to review my draft DS Forms and I-134, etc, but they told me to hold those and wait for the NOA2. So now the time has come, we have an NOA2, and I sent them my drafts for review and finalization. They tell me now.....that I need notarized letters from my banks saying when I opened my accounts and showing average monthly deposits and current balance! I have current bank statements (I can pull them from on-line data), I have current stock and Roth IRA statements (I get them the same way) but I have no way of walking into my bank at this date and getting a "Notarized letter". I'm living in the Philippines and one of the reasons I used an attorney was to act as my proctor, I have no quick access to my U.S. Banks. Is a "Notarized letter" from my banks really necessary? The attorney also wanted me to get my tax returns "Notarized". That is not happening either since there are not any Notarys available in Cebu! Does anyone know if this action is necessary?

If you are going to need assets to make up any income shortfall then probably yes... If your income alone is enough then probably not

you hit the nail on the head honeybadger!!we retained a lawyer too and since we got our NOA2 i keep on badgering her(which is my right) if i need to get all those ds forms and my fiance's ITRs w2 and I134..but alas all she can say is for me to relax and to wait until we get a letter from NVC..lawyers are pain in the ###!!!!

In agreement here R&M,

I do think the lawyer probably saved us from an RFE as I always leave something out. I did not wait for the lawyer (admin assistant) to say go ahead and drafted all my forms. Finally, afterwe got the NOA2, she did say to send them to her even though we have not heard from NVC yet (its only been two days).

The good thing is, we have little to complain about since I'm able to be here with my Honey during the entire process. I'm twice retired with no need to rush back to the US . In the meantime, we will enjoy Cebu as much as we can cause with fuel prices going up it may be a while before we get back for a visit!

Thanks for the "Common Sense" reply...you are probably right. I will have no shortfalls, I'm twice retired and my income is enough without the other assets, so I won't worry. Your explanation made me feel better...maybe you could give some advice to my lawyer on how to treat clients!

maybe not the bank letters.. just Bank details that you received every month that you get to keep..would do..

During my interview, the prescreener asked for the notarized I134 only, but I still gave him my fiance's form 1040 and W2, both are just photocopies. He didnt ask for the bank statement. You may bring the online bank statements. They may come in handy.
