First thing, I am filling out the G325 for my SO and ran into a bit of a snag. She does not know her exhusbands birthday. Can we just leave this blank?

Second thing, apparently in VN you can pick your own birthday as far as the government is concerned or the government can select one for you. For example: Her parents were born on Christmas and New Years Day. The VN government decided to make Linh 2 years younger than she really is. Her old marriage certificate is several years older than her actual marriage date.

Linh says this is fairly common but my American-ness is not grasping this. Is this going to be a problem?

It's important to fill in everything. If there's a item that doesn't apply then write, NA or None for things like children. Leaving anything blank will get you a RFE from the USCIS.

As the dates, everything needs to backed up and consistant. Her birth certificate should match her age on the marriage certificate, etc. Any dates, etc that can't be lined up need to be explained why the facts don't match. The HCMC Consulate will blue slip you at the interview for these kinds of differences. It may be "normal" for Vietnamese to have several different sets of facts but the Consulate doesn't think that's ok about the beneficary.

In our case, we mistakenly had the wrong birthplace for her mother on the G-325A, we told the Consulate about it before her interview. The Consulate wasn't concerned about that once they understood it wasn't Thi's birthplace that was wrong. they said to write a statement and bring the original birth certificate of her mother's to the intervew. We did but they didn't ask for it at the interview. The DS-230 submitted at the interview with the correct birthplace was accepted without a problem. Thi forgot to bring up the statement about the different birth places as well. When I called after she got her pink slip to ask if they wanted it, they said it wasn't important now that she had the approval.

It's best to present the best case in your I-129f and get everything settled before you get to the interview. At the interview, they like to hand out blue slips if they have questions instead of asking if you have the info with you.

COs want to see consistantcy. Mixed up BCs and other documents makes it tough on them. If all your ducks aren't in a easy row to shoot you'll be in trouble.

You want to make it easy on them. Also they are Americans that probably think like you!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship
