Drew, the reason for the hardship letter is because your fiancee already has a 10 year ban for illegal presence greater than 1 year. Therefore, she is ineligible to receive a Visa.

HOWEVER, you can file a Waiver (this is technically a waiver of inadmissibility). This will allow her to return sooner than 10 years is up. The only thing is, in order for it to be approved, you need to show that you would suffer hardships if she can't return. For example...say you have a medical condition. You say, I have this medical condition that can't be treated adequately in Mexico (and get a doctor's letter). Or, I couldn't get work in Mexico, or I couldn't pay back my debts in Mexico. The MOST extreme hardships are medical or family-related, for example, if you provide support for a parent or relative. Also if you have any children by a previous relationship, that's considered a hardship. Just think about it-what would happen if you had to move to Mexico to be with her? Or what would happen if she couldn't come back here for 10 years? Write it all down and provide documental evidence.

If she is already in the States I would go and talk to a good immigration lawyer before you do anything and before she leaves the States....

I understand now............thank you all so much. I have saved this convo as a Word doc. so I can refer to it later................I am so glad I came here........now I know things are possible and have a clue as to what avenues to explore!!!!!

I met a beautiful Mexican girl whom I am deeply in love with. She recently returned to Mexico to be with her dying grandfather.
she lived here for 2 years illegally and went back home 2 months ago

If she is already in the States I would go and talk to a good immigration lawyer before you do anything and before she leaves the States....

can someone tell me ..........what is the very first form she needs to complete and where I can find it? Is it a printable form from a website or will I need to drive to the embassy to aquire it? She has never applied for legal entry so there is nothing on file yet............thanx again!

this is where i'm confused..............I want her to be able to come here eventually as my fiancee/wife, I know it will take alot of time and I know I need to file the waiver and hardship letter and all............but what form do I need to get the ball rolling.........

You have to decide whether you want her to come as your fiance or wife. Have you read the Guides?
