Hello there,

I got married on the June 25th and now I am going to fill out the AOS...

Yes I did read the guides and faq but I still need more info so I can acknowledge more of what I'm doing.

So this is the guide I found (please let me know if Im missing out something!!!) :wacko: and I added questions and specs I need to know more about:

1. Payment for both the I-485 and the biometrics fee (total 1010$ in 1 cheque right? what if I want to fill out the EAD and Adv. parole? Do I write out separate cheques for separate forms?

2. Cover Letter... Is this really needed?

For the table of contents, let's say my I-845 is on page 12 of my pile of paper. Should I write p.12 on the bottom corner right of the form A-845?

3. Form I-485: Petition for Alien Relative

4. Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps).

4a. Copy of the non US Citizen Spouses K-1 or K-3 Visa from Passport

5. K-1 Visa Holders: Submit Copy of NOA2 "Approval" for I-129F **

K-3 Visa Holders: Submit Copy of NOA2 "Approval" for I-130

-> Huh? you mean the copy of the paper that says that they accepted my case and that they're gona send me the packet 3 when at the beggining of the K1 visa process?

6. Copy of the non US Citizen Spouses valid I-94 (front and back copies)

-> I actually only have the ripped out form of the I94 (normal right?) The size of it is about like a avg size of a card... The front states my Deparure Record (name, citizenship, date of birth) and the back says "warning: A nonimmigrant who accepts unauthorized employment is subject to deportation" etc etc but he bottom is blank, where it says "record of changes... Port: Date: Carrier: Flight#/Ship name: "

I will scan this card if you need!

7. A copy of the intending immigrant's birth certificate along with English translation. (If in any language other than English)

8. A certified copy of your marriage certificate. (If filing for your spouse)

-> We told the judge that we need the certificate in a hurry and he said that he could get it for us ready in few days. What if he couldn't (of if there was a problem etc)? I heard that if you can't get your AOS papers ready within 90 days of entry you can't stay in the States (expired visa?)

9. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

10. G-325A (all four pages) filled out,signed and dated

-> I remember already filling out a G-325a (biography) form at the beginning of this whole K1 process! I have to fill it in again? I thought they would be in the envelop the embassy gave me through mail after the interview.

11. I-693, Medical Examination of Aliens Seeking Adjustment of Status. (If you already have this from your overseas Visa Interview submit a copy that medical check form; No fee is required in this case. If you are a K-1 fiancé(e) or K-2 dependent who had a medical examination within the past year as required for the nonimmigrant fiancé(e) visa, you only need to submit a vaccination supplement (I-693A), not the entire medical report. You may include the vaccination supplement with your adjustment of status application.)

->I don't have my examination papers anymore since I handed them over to the embassy at the interview for the K1... All that I have left is the X-Ray (What is the X-Ray for anyways!) and the vaccination paper... On the vaccination paper it says FOR USE I CANADA ONLY and the title says VACCINATION DOCUMENTATION. There's a table with check marks on vaccine that I got... So do I have to send the I-693 form to the place where I got my medical exam done back home for them to complete it?

12. I-864, Affidavit of Support (see poverty limits here)

>> Include any additional required supporting documentation

->Basically it's like another I-134 for the AOS?

13. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment as noted here.

14 I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

>> Include any additional required supporting documentation or photos as well as payment as noted here.

* Fingerprint fee not needed for applicants under 14

** Should this document be misplaced/lost/never received you can file an I-824 to receive a duplicate copy via mail.

P.S: I really wanted to know... What if I don't file the AOS after 90 days of marriage, will I be considered "expired" as a legal person to stay in the States?

6/07 - Forms got resent back to my Fiance because I forgot to sign some papers. [silly me]

11/28/07 - Got my K1-Packet 3!!! It was a headache to fill in the papers.

2/15/08 - Sent all documents and forms through express! I was close to the expiration date

3/27/08 - Interview letter!!! I was in the US with my Fiance so I couldn't come back in time, rescheduled appointment.

4/24/08 - Got my interview done :) Approved! Passport+visa+brown envelope will be sent within a week.

5/1/08 - Got my Visa!

~ Flying to US on 6/11/08.

~June 19 2008- Married!!!

7/25/08 - Sent in AOS: I-485 along with EAD, AP.

8/7/08 - EAD, AP, AOS touched.

8/19/08 - Got an RFE for I-485... Fixing it.

8/22/08 - Biometrics taken in Portland.

10/08 - Another Bio (for work authorization card).

-- received my work authorization card and advance parole papers in meantime--

1/15/09 - AOS INTERVIEW *faints* in Seattle, Washington.

2/2/09 - Green Card!

Not really needed, probably just goes in the bin anyway. Can be useful for your benefit to make sure you have everything in the package. Don't write anything on the forms that you're not told to, such as page numbers

It means the copy of the I-797C that your US fiancee received saying the I-129F petition had been approved.

I will scan this card if you need!Yes, this is the portion of the I-94 they are expecting you to send.

I heard that if you can't get your AOS papers ready within 90 days of entry you can't stay in the States (expired visa?) There is no requirement to submit an AoS application within a certain time. As long as you got married within the 90 days that the visa gave you, you'll be ok. It's better to file it sooner than later so you can get an EAD and start working, but if you get held up by the cost of the AoS application, or any evidence you need, it's not going to be an issue.

9. Two passport-type photos (see specification) of the Non US Citizen Spouse. Write the full name on the back. Place in a plastic bag and label the bag "Photo of <Insert Name>". Attach the bag to a sheet of paper and place behind the corresponding G-325a.

-> I remember already filling out a G-325a (biography) form at the beginning of this whole K1 process! I have to fill it in again? I thought they would be in the envelop the embassy gave me through mail after the interview. It's asked for, so submit it. Forget about what you may have already given for the K1 application, this is a new application so they ask for new evidence. Details could have changed, such as your name (if female and took spouse's name for example).

There is a sticky post in this forum explaining this. Some forum members have submitted just the form you have and had no problems with their application, some have submitted the form you have and been told by USCIS to get I-693 appendix A completed. The sticky post will give more information, or search the forum. It's widely been discussed.

Sort of. The I-864 has instructions on what documents to submit with it. The big difference between the I-134 and I-864 is that the I-864 is a binding contract between the person that signs it (probably your spouse unless you're doing a joint sponsor) and the US Government. They are agreeing to support you rather than have you become a public charge. This contract does not end even if you get divorced. Only naturalization, deportation, death or accruing 40 quarters of social security contributions will end the contract.

13. I-765, Application for Employment Authorization, if you want to work while your application is processed (optional)

14 I-131, Application for Travel Document, if you need to travel outside the United States while your application is processed (optional)

Aaw thanks a lot RatBox for reading my long post :)

I'll try to find more info about the vaccination issue, I read some posts about it then I got very confused. Thanks again~ ^_^

Answer to question#5, is a copy of I-797 (NOA2) ...

Answer #11, medical form (I-693), you need a copy of vaccination only. a lot of folks, don't have this copy either. I am still waiting from mine from the old country. my mother-in-law think we have a copy, the vaccination one. I heard a VJ forum discussion that a Doctor here in USA is doing the copy over to form I-693 for $20. I'll find out more if this can be done. Will update it on this forum when i know the fact. This is the only stumbling block (obstacle) that prevent me from filing AOS at this time.

ps, AOS can be filed after 90 days up to a year, because medical exam valid up to a year before filing for AOS. This forum (VJ) or ***removed*** recommend filing shortly after 90 days if I recalled it correctly.

You're referring to Dr Arnold in Texas. Yes, she does it for $20. I got my DS-3025 copied onto an I-693a this way at the begining of the year when I filed for my AoS.

As a side note, AoS can be filed after a year, you'd just need to have a new medical. You don't have to file within the validity period of your previous medical, it will just cost more if you don't.

Hmmm OK...

I have a similar copy of the I-693 but in a Canadian version (on the copy it says in Canada only). I can just give this copy to some civil doctor to get my I-693 filled right? Only in Texas? More information please :) *thanks*

And what is this DS-3025 about?

Sorry I couldn't edit my last post anymore so I am forced to double post :oQuestion #1:

I have a similar copy of the DS-3025 but in a Canadian version (on the copy it says in Canada only). I can just give this copy to some civil doctor to get my I-693 filled right?

"IT IS NOT NECESSARY TO INCLUDE FORM I-693A IN THE AOS SUBMISSION. All your medical information is enclosed in the brown envelope which was handed in at the POE. The envelope is then forwarded on to USCIS where it will be consolidated with the I-485 submission, once received. If you received a copy of the Vaccination Documentation Worksheet (Form DS-3025) from your Panel Physician, you may include a copy of that form in your AOS submission in place of Form I-693a."

Now this is confusing. Does it mean I don't have to send in my DS-3025's Canadian version and get the I-963 filled? But as a consequence I will probably get a RFE for not sending them in, correct?

Question #2: When I'm done filling out all the forms... Do I send in my EAD and the I-485 together at the Chicago office?

Question #3: What is the address in Chicago to send in my forms?

@RatBox: I just glanced over at your timeline and it says that you got your green card recently! GRATS! Wow that was fast though, took only 6 months to get your card!
