Hi, I came to america with my husband on April 22, 2006, We got married here in 90 days prior to our arrival for adjustment of status, and I got my greencard on June 12, 2006, I been in America for over 2 years now and last May 21 this year we filed the I-751 form to remove the conditions of my greencard and just a few weeks ago I received a nottification for my interview and biotmertric date which it will be this month, but our marriage is not gonna work anymore, We have no child and there is no third party involve, just a lot of differences between us, and we try to fix our differences but it cannot be fix, My problem is after my interview for removing the conditions of my greencard and we get divorce do i still have a chance to become a US citizen? Can I apply the N-400 or Naturalization without my husband presence? Or Do I really need to wait until I become a US Citizen and divorce? If we divorce after the interview for lifting the conditions of my greencards it will affect me to become a US Citizen? Are they going to deported me? Do I need to go back to my home country after the interview in removing the conditions, and if they approve I-751 and they give me the 10 years LPR it takes me 5 years to be a citizen right? What is the requirements to submit the N-400? Is their another interview for that? What name can I use my married or my single name? Can I submit it by myself wihtout his presence or his name on it? and I got sacred also because he said if the I-751 got approved and we divorce and have my 10 years greencard he can call the immigration office and the immigration will pick me up back to my country. Can he do that or he is just saying it? Thanks!!!

Can I apply the N-400 or Naturalization without my husband presence?

yes, but only after you have been a permanent resident (the conditional permanent residency time period counts as well) for 5 years

You don't have to wait until you are a citizen to divorce, in fact, if you will not be living together and in a sustaining marriage, you will be found ineligible to apply for Naturalisation at the 3 year mark (as is the case with aliens married to US citizens)

Are they going to deported me?

not for this reason.

Do I need to go back to my home country after the interview in removing the conditions

no

and if they approve I-751 and they give me the 10 years LPR it takes me 5 years to be a citizen right?

not 5 more years. 5 years in total

What is the requirements to submit the N-400?
you must meet all of the eligibility requirements

Is their another interview for that?

yes

What name can I use my married or my single name?
It depends upon when you apply. If before divorce, your married name. If after, your single name.

Can I submit it by myself wihtout his presence or his name on it?
Yes, it is your application

Well, without more information we can't say whether he has any grounds to declare that, but if your marriage has been bonafide, then it is most likely a case of sour grapes and nothing will come of his threats.

What name can I use my married or my single name?

That depends upon your divorce you can elect in most states to keep your married name or return back to your maiden name. The N-400 even gives you the option to acquire a new name that has to be done in a court of law first with documentation you will provide with.

Since a short while ago, my wife's conditional green card and her one year extension was running out, I checked with my immigration attorney on this matter and was told once she is issued a permanent resident card, expired, she is always a permanent resident of this country, but just can't work nor travel. But fortunately, her ten year card came in and our N-400 application is going through very rapid, she is already scheduled for her interview.

A marriage is a very personal matter and threatening your spouse is very immature that causes much more harm than good. If I truly love my wife would have no problems doing things to improve our relationship. We have talked about this a couple of times before, she made great sacrifices to come here and if she no longer has a need for me, than I could would have no longer need for her and vice-versa. But for the happiness she did give me, would do anything in my power to make her life comfortable and she said the same if our marriage did not work out. That just brought us that much closer together.

The key element that I have learned the hard way, is absolute 100% trust in your relationship, if you don't have that, you don't have anything. And threatening that person does not bring trust.
