I am a US citizen and we recently filed for the AOS of status for my husband from H1-B status to permanent residency. We filed form I-130 (with I-864 and supporting documents) and I-485 (with I-765, I-131, G-335A, I-693 and supporting documents for each).

Last week we received and Notice of Acceptance for I-130 but today we got a 'Notice of Rejection' for I-485. Below is what was specified in the rejection notice (I-797C) which I find very vague, and fail to understand what was the information that was inappropriate/incomplete which caused the rejection. Any suggestions anyone could provide would be highly appreciated:

x The entire application package you filed filed along with any fees you submitted is being returned to you for the following reason(s):

Your application package was submitted with a single remittance and one or more of the applications/petitions were unacceptable in the package for the reason(s) specified on the related Notice of Action (Form I-797). Please correct the flawed application(s)/petition(s), and resubmit the application package with the appropriate fees and supporting documents to the address listed on the bottom of the notice.

x Based on the information you provided, your priority daet could not be established. Please resubmit you application with the proper documentation to the address listed on the bottom of this notice.

"

This does not tell me anything as to what is missing in the application. Has anyone had a similar situation? We are planning to meet the USCIS representative to discuss the application. Also, does a rejection like this cause any negative affect on the processing of the application upon re-submitting?

Rejection will have no bearing on any further applications.

What was the I-485 fee that you included with your packet?

How did you answer Part 2? It sounds like you may have checked the wrong box for Part 2.

You can correct your forms and the fee amount that you send in. When you re-send your I-485, be sure to include a copy of the I-130 NOA as one of your initial evidence.

What was the I-485 fee that you included with your packet?

How did you answer Part 2? It sounds like you may have checked the wrong box for Part 2.

You can correct your forms and the fee amount that you send in. When you re-send your I-485, be sure to include a copy of the I-130 NOA as one of your initial evidence.

We attached a check of $1010 for I-485 ($930 for AOS + $80 biometric fee). There was no separate fee for I-765 and I-131, so didn't include checks for those as we filed them concurrently with I-485. We also attached a check of $355 with form I-130.

We checked (a) in Part 2 (an immigrant petition giving me an immediately available immigrant visa number has been

approved) which seemed to be closest to our case - marriage based AOS from H1-B to Permanent residency (I'm a US citizen).

You sent in the right amount and the checked the correct box for Part 2. So, it makes me think that the person who processed your forms made a mistake.

I see that in your first post you indicated that you attached the I-864 to the I-130. Did they keep the I-864 or did they send it back also? If they kept the I-864, you might need to attach another one to the I-485 as that's where it should have been attached in the first place.

I'm just guessing here as the notice does sound vague.

You sent in the right amount and the checked the correct box for Part 2. So, it makes me think that the person who processed your forms made a mistake.

I see that in your first post you indicated that you attached the I-864 to the I-130. Did they keep the I-864 or did they send it back also? If they kept the I-864, you might need to attach another one to the I-485 as that's where it should have been attached in the first place.

I'm just guessing here as the notice does sound vague.

Thanks a lot for your help! Yes, they kept the I-864. I'll attach it again with I-485. We have also scheduled an appointment with the USCIS office on Tuesday, if he is also not able to point out anything wrong with the application, should we just go ahead and re-file the same application? When we called the USCIS CS center, even they could not give us any insight into the reason for rejection.

Also, what would they proceed with the processing of I-130 or would it be kept on hold till we re-file I-485?
