A silly I-864 question...

Filed: Other Timeline

In part 4, section C of the Affidavit of Support from there's a line where you write down 'most recent tax year'. I'm a little unsure what to put here - I didn't file a return last year (for 2004) because I was a full time student and had no income, and of course I'm including a statement explaining this with the affidavit...therefore the last tax year for which I actually filed a return was 2003, so do I put this on the 'most recent tax year' line? Or do they want me to put down the most recent tax year for which I would have filed? Some of this seems to defy all logic but the stress is making me paranoid!

Going on from there, I don't know what to put as my income because I'm still a student, hence 0 income. My dad is basically footing the bill as a household member to make up the income requirement. So do I just write that my current income is 0 and this is acceptable as long as my dad's income meets the poverty requirement for the household size?

Thanks for any help, in the meantime I'll have to get back to trying to get through to NVC over the phone!

It's not a silly question. Put 2004 since that is the most recent tax year right now. Put 0 since you didn't have any income in 2004, then put the joint sponsor's income where it says income of other qualifying person. Have the cosponsor fill the I-864A and notarize his signature.

It's not a silly question. Put 2004 since that is the most recent tax year right now. Put 0 since you didn't have any income in 2004, then put the joint sponsor's income where it says income of other qualifying person. Have the cosponsor fill the I-864A and notarize his signature.

thanks for replying! If I put down that the most recent tax year is 2004, do I just not check off any of the boxes above that line? (the ones that ask whether you filed a single or joint return etc)?

They ask for the most recent tax year, provide the most recent tax year. There are no qualifiers in the quesion, much as you might wish there were.

Same for current income - answer the question that is asked. If the correct answer is zero, that's the correct answer and therefore the only acceptable answer (no matter what your Dad's income might be).

The question is straight forward. Write the filing status and amount you made for the most recent tax year. If in 2004 you made 0 dollars and filed as single, then put that.

this is basically what my husband said, haha! We decided its my tendency as an english major to overanalyse every single word on the forms whereas he has a background in civil service and can read forms the way they're supposed to be read! Thank you!
