My friend got her K1 visa from HK, and she is in US now, about to apply AOS, but different than then Mainland ppl, when she applied for the K1 , she didn't get her "police clearances" like us, the HK ppl just applied it from the police station, and they will send it directly to the embassy, so she didn't keep any copy, and now she need to submit it for the AOS, how can she get it? Does she need to apply again from HK's police station? and let them send to where ????? :bonk:

thanks for advance of your help~~~`

Police report is only needed for the K-visa, NOT for adjustment of status.

Just follow the guide.

Hello, YuAndDan

Thanks for your speedy reply. appreciated it!

I clicked on the site you provide, and it does not show they need police report, which made me really happy.

However, when i see the USCIS webpage about applying AOS, they do say "police clearances " is needed. http://www.uscis.gov/files/form/i-485instr.pdf

I got my K1 visa from China, and i already got my 2 years greencard, i did submit my police report when i applied, not sure they used it or not, but i did that according to the guideline.

so im kind of confused~~`

again, thanks for your help!

If you already have your 2 year greencard then why are you applying again for AOS??? No police certificates are needed for AOS.

Police clearances may be needed when adjusting status from an OTHER visa like student or visitor's visa. K-Visas had this handled before getting the visa, K-Visas have immigrant intent, visitor's visas do not.

Read the directions again:

If you are filing for adjustment of status as a member of a special class described in an I-485 supplement form, please read the instructions on the supplement form to see if you need to obtain and submit police clearances, in addition to the required fingerprints, with your application.
K-Visas are NOT members of a special class, and do not use an I-485 supplement form like I-485A. Edited by YuAndDan

Yep, you dont' need your police record for AOS from a K1.

Life's just a crazy ride on a run away train

You can't go back for what you've missed

So make it count, hold on tight find a way to make it right

You only get one trip

So make it good, make it last 'cause it all flies by so fast

You only get one trip
