second marriage-based AOS pending (same wife); am I eligible for H1B or employment based EB3?

Also, when applying for H-1B you will be asked two very direct questions:

Have you ever applied to be an immigrant?

Have you ever been denied a visa or been placed in removal proceedings.

From the sounds of it, your AOS went south. Personally I think you'd have a hard time getting an H-1B visa approved considering that USCIS have already judged you to be guilty of immigration fraud.

Timeline

I am on H1 Visa as well and filed for AOS on 04/27/2007.......My job was in California and my wife's house and job is in Atlanta.....

But unlike you I quit my job and moved to my wife's house since we got married. It looks like your motive is just to work here in the US.

02/01/2016 - B-2 Visa declined

03/05/2016 - B-2 Visa reapplied

03/18/2016 - B-2 Visa declined

This thread is ancient... looks like it got bumped a while ago without anyone noticing how old it was. And here it is, back again... :whistle:

2005 - We met

2006 - Filed I-129F

2007 - K-1 issued, moved to US, completed AOS (a busy year, immigration-wise)

2009 - Conditions lifted

2010 - Will be naturalising. Buh-bye, USCIS! smile.png
