Can you do DCF if you have dual citizenship?

Timeline

Hi everyone, just a quick question. I have dual citizenship (American and Albanian). Does that mean that I'm eligible for Direct Consular Filing in Albania for I-130 or do I still need to have lived there for at least 6 months?

To be eligible to do DCF, you need to be USC and resident in the foreign country where you want to file. So you should still have to have 6 months residence in Albania. The best way to find out for sure is to contact the US Embassy/Consulate there.

If you've currently been in Albania for a little while, even as short as a month, and you can stay be there for at least seven months in total, I would still go for DCF. You can go back to the US after filing. It would still be the faster, simpler process.

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
