Just a couple questions, please help

First of all, I apologize, but I have some really dumb questions...

Paul's card expires in 4 days!!! When we were approved for the 2 year, we signed an affidavit saying we would file again in 2 years between Feb 2- May 2 2008. I guess we're not late as long as we have it post marked by the 2nd, am I right? Please say yes!

And....

While the case is pending, is he allowed to still work here? His drivers license also expires on the 2nd of May, will he be able to renew it?

05/08/08 - Received Extension letter

05/17/08 - Received Biometrics appointment letter for May 31, 2008

05/24/08 - Received 2nd letter for Biometrics appointment for June 4, 2008

05/31/08 - Went to biometrics appointment on May 31, 2008, said Paul did not have to go on June 4th, computer glitch.

06/04/08 - Case was "touched"

As far as I am aware, there are probably better people to answer this, you are ok as long as you file with in the Ninety day period preceding the expiration of the green Card.

As for being able to work, once USCIS receives your application I-751 Removal of conditions they would send out a NOA saying they have receive your application and the letter gives a 1 yr extension. Saying that these may take a while to get to you or not at all if you filed at TSC just recently so you will need to get passport stamped. Until then you will be in a bit of limbo. I suggest that you get you application off to them as soon as you can and make an infopass appointment to get your passport stamped, you will probably need proof that it has been sent and received.

As for drivers license, it depends on the state you are in, Georgia pretty tough and i have had problems in the past. be prepared that you might not be able to renew until you have the letter or the stamp in the passport. Also they may only renew the DL up to the point that the letter or stamp is vaild for.

As long as you mail it by the date of expiration on the greencard - you are OK. Make sure and send certified with acknowledgment along with next day delivery etc. and have the USPS papers with you as proof that you filed in time. Look at the greencard's expiry date and beat it. Driver's license is a ####### shoot depending on which state you are living in - some states will give you a new one when you show the extension letter - others won't. He is eligible to work with the extension letter - so that should not be a problem - but you need to send the I751 fast - so you can receive it in time. Good Luck
