my fiance was laid off from his job a while back and since he is from a small town there has been very little opportunity for him to be employed. the odd job here and there. he will have a job secured mid-summer, but nothing at the moment.

how will this affect our visits when i mail our I-129F? how will he be able to convince border guards (should he be asked) that he has NO intention of illegal immigration? once we mail the I-129F do they type our information in their computer?

do they know at the border who has/is applying?

any help would be appreciated!

05.25.10 - NoA

06.25.10 - biometrics appt

07.02.10 - emailed that our case is moved to CSC!

07.14.10 - touched

07.21.10 - touched

08.03.10 - approved for EAD

08.05.10 - uscis mailed out EAD

08.09.10 - EAD received!

01.05.11 - a ###### RFE over 6 ###### months after the fact

02.01.11 - touched

02.14.11 - APPROVED (finally)!

02.25.11 - received green card in the mail

DONE WITH USCIS FOR 2 YEARS!

Well, firstly, remind him that he always must tell the truth to the border people! Secondly, bring evidence of his return to Canada. Without a job, he could bring rent receipts, utility statements (in his name), perhaps bank statements. Could he have a professional in the community "vouch" for his return? Perhaps a personal letter from someone he knows well that is a doctor or lawyer. If he's not renting, perhaps mortage papers. Appointment letters if he has them might also help...like a letter about an upcoming appointment somewhere. I'd bring his I-129F paperwork, or some of it, so he could explain that he's not going to immigrate because he is going through the legal processing of moving to the US.

The key thing is to show ties to Canada. That may or not be employment. I'm sure people will pipe in with other suggestions. Hoping for a successful border crossing! (F)

i had no idea there was a canadian forum on here! thank you i will definitely be posting there.

i haven't been able to find out if anyone knows what they record on the border computers. it's a shame.

My fiancé who is Canadian came to visit a couple of weeks ago, and was stopped at the border. He told the border guard that he was going to visit his girlfriend, but when the border guard checked his trunk and found some of our wedding invitations, he was told to go inside. He said it seemed like they knew that he was in the process of a K1 visa, but just wanted to make sure that he had no intentions to immigrate early. The border guards seemed happy that he was doing it the 'legal' way, and sent him on his way.

Basically, I would just assume that they know everything, and have your fiancé bring any and all evidence he can to the border to prove that he has no intention of immigrating.

K1 Timeline

March 2006- Met on my Spring Break, started emailing/calling each other daily.

June 2006-Started dating.

December 2007- Started getting papers ready for K-1.

December 23rd, 2007-- OFFICIALLY ENGAGED!!

Late December- Mailed all of paperwork off to lawyer.

January 1st, 2008- Attorney mailed off first package.

January 16, 2008- Received package back because check was from Canadian account.

Mailed correct check immediately.

January 29th, 2008- CSC received package.

February 8th, 2008- Received our NAO1

June 5th, 2008- Received our NAO2 via email!!! yay

August 27th, 2008- Interview- APPROVED!!

October 11th, 2008- POE Blaine: Moving for GOOD!!!

AOS Timeline

November 3rd, 2008- AOS Packet received in Chicago

November 12th, 2008- Check cashed!

Basically, I would just assume that they know everything, and have your fiancé bring any and all evidence he can to the border to prove that he has no intention of immigrating.

Once you've received your NOA1 you should be given a case number. If your fiance carries this with him, it'll prove that you are going the legal route and they could check their computers or files or whatever else they have to verify that!

Carlawarla was perfectly right. Be honest at all times. These people can SMELL lies. If your fiance seems honest and legitimate, declares he has no intention of immigrating illegally and isn't carrying stuff with him that indicates otherwise (like all his treasured belongings and all his clothes!) he should be just fine. Just as with all things in this process, the more evidence you have to support you the better.

Sep/Oct 2006 - We met online randomly, courtesy of Google and Myspace! Became best friends very quickly!

May 2007 - I booked tickets to go see Lauren in AL in November '07

June 2007 - Decided to date online

September 2007 - Fell in love!

November 2007 - I flew to Alabama to meet Lauren for the first time. We spent a PERFECT week together!

April 2008 - Lauren came to stay with me in England for a week!

May 5th 2008 - Mailed our K-1 application

July 31st 2008 - FINALLY received NOA1 (letter)

November 20th 2008 - Visited Lauren in AL for her birthday =D

January 21st 2009 - Received our NOA2 (letter)

February 6th 2009 - Received Packet 3

February 9th 2009 - Sent off Packet 3

February 20th 2009 - Medical

March 5th 2009 - Received Packet 4

March 12th 2009 - Interview - missing co-sponsor I-134 and tax returns! D'oh!

March 17th 2009 - Sent off missing forms and passport to US Embassy via SMS courier

March 23rd 2009 - Passport returned WITH VISA!

April 9th 2009 - Flying to Alabama
