I134 minus 2007 returns?

Folks,

Can I submit I134 without the 2007 returns? I hav efiled for an extension as I'm in India and would be returning only around end of May 2008. Can I in the interim show my returns from 2004,5,6 and also my bank balances and savings as a proof of support?

any guidance would be greatly appreciated

Really depends on your income and assets. While at my wife's interview, I was horrified as some people (at least 4) emerged from the interview and said they were blue sheeted, asking for 2007 returns. I did not have the W2s for my return (but I took the return for my wife to sign just in case she was denied or refused), and I was horrified we would be blue sheeted and told to come back the following Monday (our embassy processes blue sheet returns on Mondays)... I was flying out Friday.

When we were called in, they never said anything about the 2007 return (it was the day after the filing deadline). My income for 04, 05, 06 were way over the minimum 125% poverty line, my employment letter from december was way over the required amount, and my assets were enough to qualify by themselves (and yes I included assets even though I didn't have to). I don't know why they wanted some 2007 returns and not mine. Maybe those people had employment letters stating a much higher current income then their previous tax returns showed (got a big raise, promotion, new job, something since 2006) and the CO said you qualify for sponsorship if you can show me a new return that has more $$ on it from 07? Maybe I got by because they counted my assets and I escaped their fate by simply going for overkill? Don't know. But if your assets qualify you for support, you should be ok.

05/14/2007 - Sent I-129F for K3 to Chicago Lockbox via USPS Express Mail

10/22/2007 - I129F APPROVED (161 days), I130 APPROVED (188 days)

11/08/2007 - I129F received at NVC, embassy case number generated.

11/13/2007 - I129F forwarded to embassy.

11/18/2007 - 129F petition received at embassy

01/09/2008 - finally, DOS gives me the interview date, April 16, 2007 (ouch)

01/23/2008 - never got packet 4, emailed embassy

04/11/2008 - picked up packet 4, did medical

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

thanks for the insight.

i'm a bit worried due to various instances about the latest tax returns or a notarized letter as to why tax returns weren't filed. I have a legitimate reason i.e. working in India and all my tax related W2s are in USA. plus the added headache i require a CPA due to the various states of incomes.

the fact is true for my case i.e. my 2004,5,6,7 incomes are definitely way over the poverty line and I do have substantial liquid assets as well to circumvent the income requirement, just not sure if they are hell bent on 2007 returns to help IRS.

either ways i will check with the consulate and find out the next steps. sent them 2 emails no luck will try the phone for a change.
