K3 & EAD expire in six months.

i would appreciate some advice on my current situation. i have a K-3 visa that expires on 10/15/2008. i got my EAD over a year ago now that also expires on 10/15/2008. i just sent my AOS package yesterday. SO, the big question is - what happens if i do not get my greencard before my visa and EAD expire? will i lose my job? should i be trying to renew my EAD? if so, can someone please tell me which form to use. thank you.

90 days before the expiration of your EAD, send in a application for your next one and include the NOA from your I 485 so that you do not have to pay any fees. Use code C 9, as opposed to A 9 that you used on your original application. Also you might as well at that time also apply for AP.

Use the I 765 form again.

You should not lose your job. You will have proof in the form of your NOA that you have applied for a renewal.

This is not true. This only applies to lost/stolen/damaged cards. Read below:

In certain instances, the employee may use receipts in lieu of original documents in the Form I-9 process. For example, if an individual’s document has been lost, stolen, or damaged, then he or she can present a receipt for the application for a replacement document. The replacement document must be presented to the employer within 90 days of hire, or, in the case of reverification, the date employment authorization expires. For more information on the receipt rule, see the M-274, Handbook for Employers.

(Note: A receipt for an application for an initial or renewal USCIS Employment Authorization Document (EAD) filed on a Form I-765,

Application for Employment Authorization, is not acceptable for Form I-9 verification purposes.)
