I-129F for K3 at NVC

I am waiting for my I-130 to get to NVC because that is what I want now. Yes I know there is a delay and I might have to file the I-824. But now what is going to happen next with the I-129F? What happens after it is sent to Mexico?

* Jan 3, 2003 - Met the love of my life

I-130:

* Jul 16, 2007 - Sent I-130 to Nebraska Service Center

* Jul 19, 2007 - I know it's sitting in the PO Box today

* Jul 27, 2007 - Check cashed for I-130 Fee

* Aug 2, 2007 - NOA1 Arrived in the mail dated Jul. 25

* Sep 19, 2007 - ~Touch~ Placed with I-129F

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

* Jun 3, 2008 - Entered into NVC System

*Jun 4, 2008 - DS- 3032 emailed

*Currently waiting to send I-864.

Usually the approved I129F is sent to the NVC, the I130 is held back until the beneficiary adjusts status once in the US. Not sure whether you can call USCIS and ask them to send the I130 to NVC instead of the I129F.

Thank you for your response Nick/Nadia....yes I have called and I talked to California Service Center. They told me that they did send the I-130 to NVC. For now I am not trusting that, but I originally was only going with the I-130 and put Mexico as the place for adjustment so it may be true that it was sent, but who knows. For now (until I see a case number on the I-130) I am going to conintue on with the K3, but I am not sure exactly what happens next. I mean I know it breezes through NVC and then is sent to Mexico, but am I assigned an interview right away or is there more forms and fees that I should be expecting before the interview?

You can call the NVC and find out which case they have. If they have the I130 with them and are continuing with processing it, great, you have what you wanted. If they only have the I129F, they will continue processing that one and you will adjust status in the US. Yes, when the I129F leaves the NVC for the embassy in Mexico, there are forms and fees which you will have to complete and pay. They will send you (or you could collect) what is called Packet 3 which is a checklist which must be complied with and forms which must be completed. That is sent back to the embassy once you have in your possession the documents they request on the checklist. Thereafter they send you Packet 4 which contains the instructions for the medical examination and your interview appointment. Prior to the interview there is a fee that you need to pay (Visa Fee) as the receipt must be presented at the interview. Hope this helps. I didn't check but when did you get approval on your case? If in March, call the embassy, chances are your case is already with the embassy in Mexico (this was the case with ours). But please, make a call to either the NVC (speak to a person) or the embassy to get more certainty with your particular case, which petition is being processed and where in the process you are. Let us know what happens :-)

Nick - Thanks for the great help. I called NVC and they told me that my I-129F was in their office on April 7. So I expect they will be forwarding it any day now. They say they have no record of my I-130. I called USCIS's CSC (RFE trick). The man there stated that my I-130 is also being forwarded to NVC. This is where I believe they are wrong because yes I know my I-130 is suppose to be going to the local consulate for AOS later, but they keep insisting that my I-130 is on the way to NVC cause that is what they stated on the NOA2. The lady at the general USCIS line told me to try back after 30 days. If NVC still does not have my I-130 then to call USCIS back and they can assist me more with it.

Thank you so much for clearing up the process on K3. I read the flow chart, but I was still a little confused on it all. Thanks!

A garcia, I noticed you are also going through CDJ.

CDJ only will send you 1 packet for K3. The packet will include info on what to take to you apt and it has your apt date. You will not need to send anything back to them. You just take all the stuff needed to the interview. Go to the CDJconsulate website and on the K3 section it shows all the forms that will be needed.
