Hello Fellow VJ.

Please Help me. . .

Do you think Consul will ask for an Authorization letter from my parents, notarized by a Lawyer???

Im turning 23 on July, Im quite confused if I have to do this. .

I believe Im on the Right age to Marry.

Anyone there can advice me, or experienced had their K1 interview at the age of 22????

I highly appreciate your suggestions.

Salamat

Nope. I'm 100% sure there's NO parental consent needed for you. :-)

Good luck!

Actually contracting marriage when you are below 18 is prohibited because the legal age to contract marriage is 18. Parental consent is required for those who will contract marriage 18 to 21 yrs old. Parental advice is needed also when contracting marriage at 22 to 24 years old. However since the OP is being petitioned for K1 visa where marriage will take place here then neither parental consent nor advice is needed.

Removal of Conditions :

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

Good info here.. The letter of the law here in the Philippines is:

22 and under - Notorized parental CONSENT required.

23 or 24 - Notorized parental NOTIFICATION required.

But, as correctly pointed out above -- this doesnt apply for the US Embassy.

It DOES technically apply for CFO. But , you know, this is the Philippines , so adherence to laws are based on time and place and person you are dealing with.....<sigh>

Warm Regards,

Samby

  • 3 years later...

I am 21 and the seminar still want me to submit parental consent and self affidavit even if my mom is with me. they need me to write with notary signed.

Persons aged 18 to 21 must have written parental consent to marry in the Philippines.

There are some numbers above which are incorrect. You can read all the details here: http://www.chanrobles.com/executiveorderno209.htm

But in summary... Anyone over 18 may contract marriage.

Art. 5. Any male or female of the age of eighteen years or upwards not under any of the impediments mentioned in Articles 37 and 38, may contract marriage. (54a)

From 18-20, you require (notarized, with two witnesses) parental consent.

Art. 14. In case either or both of the contracting parties, not having been emancipated by a previous marriage, are between the ages of eighteen and twenty-one, they shall, in addition to the requirements of the preceding articles, exhibit to the local civil registrar, the consent to their marriage of their father, mother, surviving parent or guardian, or persons having legal charge of them, in the order mentioned. Such consent shall be manifested in writing by the interested party, who personally appears before the proper local civil registrar, or in the form of an affidavit made in the presence of two witnesses and attested before any official authorized by law to administer oaths. The personal manifestation shall be recorded in both applications for marriage license, and the affidavit, if one is executed instead, shall be attached to said applications. (61a)

From 21-24 years of age, you require parental ADVICE:

Art. 15. Any contracting party between the age of twenty-one and twenty-five shall be obliged to ask their parents or guardian for advice upon the intended marriage. If they do not obtain such advice, or if it be unfavorable, the marriage license shall not be issued till after three months following the completion of the publication of the application therefor. A sworn statement by the contracting parties to the effect that such advice has been sought, together with the written advice given, if any, shall be attached to the application for marriage license. Should the parents or guardian refuse to give any advice, this fact shall be stated in the sworn statement. (62a)

Apparently the word "between" is being subjectively interpreted.

I don't know if it's worth fighting over because I imagine , form of parental advice preference... in writing....?

True, it's a tad vague... Ages from 18-21 could be interpreted from 18th birthday to 21st birthday, OR the 22nd birthday. Cuz until your 22nd birthday, you are considered 21. Same with 21-25.

IMHO, asking for parental advice is not a bad idea, but to have to prove it, or have it written... wowzers. But the Pinoy culture takes marriage a LOT more seriously than here in the US, which is not necessarily a bad thing.
