K1/K2 Derivatives with children under 21 yrs.

Hi,

This question to anyone who has a k1/k2 with child. Are there any paperworks needed by the embassy so that my fiancee can take the 2 kids with her to the United States whenever the visa is approved. The annullment is already finalized, finished and NSO Secpa in my fiancees hand and myself. I have included the kids name on the I-129F which was filed January 2008. I have a hardcopy NOA1 in hand, waiting for NOA2 approval. Any thoughts and remarks is highly appreciated. Thanks.

my daughter was K-2. as long as they were listed on the I-129f, they'll be included in the interview if you wish for them to come at the same time.

When the petition reaches the Embassy, you can call to double check that their names are included. all the paperwork will be submitted at the time of the interview.

I also have two kids who will be under K2 derivative visa... we're still waiting for NOA2 but I have already applied passport for them and also requested NSO certified copies of their birth certificates.

oh, yeah, i almost forgot i did ask a lot of questions about k2 during my first days on vj :blush:

it's all about k2: documents needed, going to the us together or just follow to join, medical experience, etc. i hope the the replies and comments from different vj members in those threads could help you.

Roy&Yazi, we are still waiting on our NOA2. we are hoping we could get it soon and have the interview in time for us to be able to leave before school year starts on Aug. 25.. i am praying we could be there at least a week or 2 before school starts so the kids could adjust a little to the environment and the people prior to starting school.

Hello,

As long as her/his name is included in the initial application and under 21 years old, there should be no problem. My daughter was 19 then. Oh, don't forget to get a CENOMAR if she/he is between 18-20 years old.

I agree with everything said so far. As long as they were included on the I-129F petition and it is approved, then they are included for the visa interview and medical. You just need to bring the kids for their own medical and also fill up a DS-156 and DS-157 for each child when you bring them for the interview. No DS-156K form is needed for the K-2's, only the Fiance (K-1). The fees for the interview and medical will also be one fee for each beneficiary, not per family. So if you have two children and one fiance coming over, the medical and interview fees will be times three.

I'm not sure how it will work now since people are apparently supposed to call in to make their own appointments once they receive a notice from the embassy, but our appoinment letter had the child's name on it too. I would assume there will still have to be some correspondence from the embassy to let the beneficiary know when to call and set up the appointment, and that would likely list all the names. If there is any doubt, ask the embassy when you call for the interview appointment down the road after NOA2, but I see no worries since you listed them in the petition.

Thanks for all the quick responses, however, my main question still remains.....that is: does my fiancee need a consent from the biological father of the two kids (12yrs and 11 yrs)? Because in applying for the kids passport, the passport agency requires a consent from the biological father before any passport will be issued to the minors. That being said......will a consent/permission/approval or whatever paperwork will be needed by the embassy to allow the minors to leave the Philippines to travel with their mother for the United States once the visa is issued?
