I found this...hope it helps....

Canada does not supply a certificate of non-impediment, however you can apply to the Departments of Foreign Affairs and International Trade for a "Statement In-Lieu of Certificate of Non-Impediment to Marriage Abroad".

Applications must be made by mail and accompanied by:

If you were born in Canada, a certified copy of your birth certificate.

If you were not born in Canada, certified true copies of your Canadian citizenship card and Record of Landing form.

A statutory declaration of your present marital status and the name and citizenship of your future spouse.

A certified copy of a divorce certificate or divorce judgment if divorced or a death certificate of a previous spouse if widowed.

There are a number of countries who will not accept this document and require instead that you get a letter or statement at the Canadian Embassy, in the country where you will marry, to the effect that there are no impediments.

Here is my situation. My fiance is divorced. His ex divorced him through Canada (where she lives). Do I still need the non-impedment? How do I get that if he has only been divorced abroad? Any help is appreciated. Thanks!

Yes, you need attach the divorce degree if he has been married before. I think that you can ask him where he got the divorce and call to the office abroad and ask for a copy of the divorce. I think they would have this service...

He never lived in Canada. They were married in Jamaica, both are Jamaicans. She went to Canada and divorced him there. I believe I need the non-impediment through Jamaica.

I am emailing the Jamaican Registrar General, I hope they can help. I'll let you know.

Hey Steph....

Yeah, you STILL need your fiance to have his no impediment to marry requested down in JA. Since HE'S still from Jamaica AND THEY WERE MARRIED DOWN THERE, he's going to need to "prove" that he's no longer married for the K-1 interview etc. Since his ex divorced him in Canada - he might need to get something from there showing he's now divorced. Does he have any communication with the ex to find out if the divorce decree exists?

If not, I would say contact the Jamaican RGD (Registrar General's office) and ask them what he needs to do to show them he's not married anymore and then proceed from there.

April 1st, 2008 - Interview @ 1:30pm- APPROVED!!!

May 20th, 2008 - U.S. Entry at JFK w/ work stamp

June 13th, 2008 - SS# Received

June 19th, 2008 - Started work w/ JFK EAD

August 11th, 2008 - Wedding

AOS Timeline

Oct. 3rd, 2008 - Submitted AOS/ EAD/ AP Packet

Oct. 6th, 2008 - AOS Packet Rec'd at USCIS Xpress Mail

Oct. 13th, 2008 - NOA1 Rec'd

Oct. 27th, 2008 - Case Trsf to CSC

Nov. 1st, 2008 - Biometrics Appt.

Dec. 10, 2008 - EAD/AP Approved

Dec. 17, 2008 - Received EAD/AP : )
