Hi,

I am just about to send out my K-1 visa application, but I have a few last-minute questions. If anyone can give me some input, that would be great! So, here they are:

1. As far as the affidavit of support goes, I just recently moved back to The States from living in Canada for the past 8 years (where I met my fiance). I am fervently looking for a new job now, but obviously I have no U.S. tax returns to show at the interview. I figure that it will be at least 6 months before i have to show proof of income, so if I get a job soon, I will have that much time to develop the proof. My question is, will I still need someone else to "co-sponsor" me and my fiance?

2. Related to the above question: if the answer is yes and someone will have to co-sponsor, what if I find someone who is not necessarily employed, but has QUITE alot of money in the bank, and lots of investments? Will that be enough to prove that my fiance won't become a charge of the State?

3. The back-up that I have included in my I-129f application to prove that we've met in the last 2 years is as follows: flight itineraries for a couple of visits we've had to to see eachother in the past 7 months, one boarding pass for a visit I took to see him, stamps in my passport for two visits to canada, and one stamp in his for visiting me, bank account records showing that I spent money while I was visiting him in canada, a ticket stub for a ferry ride I took while I was in Canada, and color photos of us together at various times in the last 7 months. Is this enough?

4. Does anything I am sending now with the I-129f need to be notarized? If so, what?

5. Someone who has never been through this process, but has many friends who have, told me today that I'd better get a lawyer to help me with all of this. I read a previous forum thread on here that said it wasn't necessary, but I'm wondering if anyone else DIDN'T use one and was still ok. I feel like the guide on visajourney has been MORE than sufficient, but I just wanted to double-check.

1, Affidavit of support is not needed when filing I-129F, it is needed much later at the time of Visa interview. Look at timelines, you may have enough income by the time of interview to solo sponsor.

2, Assets are worth only 1/3 of income, so the assets need to be 3 times poverty line if relying on assets alone, the consulate is mostly concerned with ongoing income.

3, YES :yes:

4, NO :no: Nothing in the I-129F package needs notarizing. Only later the affidavit of support for the visa (I-134) needs to be notarized.

5, Lawyer not required, We have done this from beginning to green-card, no lawyer needed, just carefully follow th guides here on VJ. Lawyers are only needed for complex things like an overstay in the USA, etc...
