Should USC Spouse attend K3 Interview?

Timeline

I'm wondering for New Delhi Consulate, how important is it for the USC spouse to attend the interview? I understand from prior posts that the USC can go into the Consulate, but are told to wait outside the area where the interview occurs.

Best situation would be to go, but given things like time, money, etc., I'm leaning against going (mostly because I want to have the time available to take off once my spouse is here, rather than use it all to go there for the interview). Any experience? Any advice? Both would be much appreciated. (If it helps in the analysis, I have not been back to India since before we filed for the K3 in early July 2007). Thanks.

The USC is not allowed at the interview.. I thought they were... I was planning to go...

K1 Visa Timeline :

07-27-2007- Sent out I-129f

08-07-2007 : Received NOA1

12-23-2007 : NOA2 approved

12-27-2007 : NVC Received

01-10-2008 : Case forwarded to New Delhi Embassy by NVC.

01-14-2008 : New Delhi Embassy received our file from NVC.

01-24-2008 : Submitted Packet 3 at New Delhi Embassy.

02-06-2008 : Submitted docs at VFS.

02-21-2008 : Interview- visa was approved pending security.

02-25-2008 : Called NVC and they said Visa is approved. VFS- they didnt get it yet.

02-27-2008: Visa in HAND!!!!

03-08-2007: Arrived at POE(JFK)

May 12-2008- Got the Marriage License

May 19-2008- Married!!!

AOS

06-06-2008 Mailed out AOS

06-08-2008 Delivered to Lockbox

06-16-2008 NOA for EAD, AP, AOS(dated June 12)

06-28-2008 Biometrics done!

I don't think there's any hard and fast rule that would disallow a USC for the interview. Should the CO think there's a need to talk to the USC and if the USC is available at the consulate they will talk to the USC.

There are instances in the past when they wanted to confirm the same answers from both the USC and beneficiary they were both interviewed at the consulate and a decision was made.

Not necessarily Mumbai consulate, this has happened in multiple consulates. (You can search the forum)

However, should you email / call the consulate and ask "if USC is allowed for the interview" the official answer is going to be "NO".

If talking to the USC is the last thing that the CO would like to do before making the decision then the CO might ask...where's your fiance/husband now ? and if the answer is "in the consulate" then it'll help.

If your documentation is solid and clear then that need should not arise at all unless conflicting / gray area answers are given at the time of interview. However for K-3s, its should be pretty easy.

Make sure you submit ALL the required documents at the VFS and carry the rest for the interview. Good luck.
