question about k1

hello to all vj members.. happy new year to y'all!!! well, my friend needs help from u guys. my friend just filed the petition to his wife as K1 visa last month, they're not married yet but they have kids. He is very confuse if the K1 is already entitled his kids as well or should he file another petition to his kids as k2? he told me that the lawyer adviced him just file k1 for his wife and just declare they have kids, so then the kids could automatically go with his wife here in the U.S?! is this right?!! so what do u guys think??!

Firstly since they are not married, do not use WIFE when referring to your friend's FIANCEE this confuses others.

If they have children, and if one parent of the children is a US Citizen, then get the birth registered at the US embassy or consulate, and get a US birth cert abroad, and a US Passport for the child, the child will be a us citizen and will not need to "Immigrate"

If the children do not have a US Citizen parent, then they will be issued a K-2 visa and accompany the K-1 to the USA.

hello , im glad to read your question here, it seem its apply to me too. Filipino ka? seen your flag! anyway we also have son he just turn 2 years old and my fiance for 3 years just pased the US citizenship but need to attent his ceremory by January. we starting gathering our requirements, but yes we have some question abput our son requirements? did u able to find the answer? does we need to get his passport at US embassy? i hope we can find answer soon cuz i already planning to file for his passport here. and my son name, he uses his daddy surname by the way! hope anybody can help!

<<<<<hi im ann my fiance my filed last month we have a 3yrs old son, he is automatic u.s citizen because my fiance his dad is a u.s citizen ,they have to inquire at fedex courier no.(632)879-47-47,to ask for application form for report birth and for u.s passport,they have to complete all the requirements first before u pass it to embassy.in my case they request dna test for my son and his dad,my son is goin to have his u.s passport this jan 2008,if u need more info just email me .ived been through with that case jus last mont.hope it will help ur friend
