Questions about I-824, process after approval?

Hi guys! forgive my ignorance. Our case was both approved last Nov.8, We got an approval notice and according to my hubby, the instructions and the original copy of that approval notice was sent to the lawyer.

I called USCIS today and asked if they already forward it to national visa center. The guy was really polite however I'm confused with the informayion he gave me. According to him, My hubby has to fille I-824? What was that? Coz our lawyer really doesn't explain much about what 's the next process after approval. She just email some questions regarding the affidavit of support.

Is the affidavit of support urgently needed? Coz my husband is very busy and we thought affidavit of support is only needed when I already have schedule for the interview.

Is it needed at NVC? Can anyone explain to us the process after approval? Are both I-130 and I-129Fbeing forwarded to NVC? What happens next?Is the I-130 being hold? coz we'll go to a k3 route. Is the affidavit of

support needed at NVC together with the I-824?

NO

After 3-4 days, you should get a case number corresponding to your location. From the NVC, for a K3 visa, it should go directly to your consulate.

The I130 hard copy should assume you are in the US already

The I129F hard copy should be forwarded to the NVC for entry then forwarded to your consulate

If both were approved together, it is very likely that they I129F will be forwarded to NVC and the I130 will be sent to the Nation Records Center for storage until you file for Adjustment of Status. This is the policy they announce more than a year ago in this press release: http://www.uscis.gov/files/pressrelease/PN_i-129f.pdf

They had some initial problems implementing this but are now pretty good at it. If both of your petitions were going the NVC, the easiest way to tell would be to look at the NOA2 for the I130, if it says it is being forwarded to NVC, it will be forwarded. If it says you are already in the US, then it will go to storage at NRC, and it will tell you to file the I824 to get consular processing on the I130.

The I129F will be sent to NVC, it has taken some recent approvals as long as 6 weeks to get to NVC. Once there, you will be put in the system, a case number generated for you based on your embassy, and the file will be forwarded. This NVC process for the I129F takes about 2 days (but could take up to 5).

The affidavit of support will be the I134, and must be carried by you to your interview for the I129F. But, now that you have your approvals, it is time to start getting it together. If your embassy issues a packet 3 with checklist, it will be one of the items that you should obtain prior to turning in the checklist to schedule the interview.

Thank you urge to race, but what happens if they forward both petition to nvc? Will it affect my k3 case? Will they let me go to CR-1 visa? That I don't want to happen. coz we are really going with the k3 route. So you mean, NVC doesn't need somrthing from us like the affidavit of support or anything? and they will just go on with the processing and all we can do now is wait. I really thank you for the information. I hope I can be like you who knows all about the process, so I'm not like this. It feels so good that I've found this site, because calling USCIS is useless and sometimes they don't know what they are talking about. YOu're even better than my lawyer. Your welcome.

Even if the I130 is forwarded to NVC, your I129F will continue on, and you can stay on the K3 path. Your I129F will sail through NVC to the embassy and you will have your K3 interview. You can ignore the bills (Affidavit of Support fee and IV fee) and the Choice of Agent form that the NVC sends for the CR1. USCIS will eventually request the approved I130 back from NVC for your adjustment of status after you enter on the K3 visa.

This is all assuming both get forwarded, which is unlikely. The best way to tell right now is to have your husband look at the NOA2 for the I130 like I said above. BTW, I knew you were the beneficiary, but the I130 would say you were already in the US if they are not forwarding it on to the NVC. That is because it will go into storage, and when they pull it for your adjustment of status, you will be in the US.

For the K3, the NVC will send your husband a letter saying that they got the approved I129F and will be forwarding it to the embassy. That is all from NVC for K3 usually.
