I-130 approved, departure date past

Hey everyone,

I have a question. My wife's I-130 petition for me was finally

apprived after 2 years. According to my I-94 i was supposed to leave

on Aug 31/07, but a critical need (my daughter's care) required me to

be a stay-at-home dad. i know i have 180 days of grace period after

my I-94 expires to lawfully leave the country. We are currently in

the process of filling out the rest of the forms required for me to

adjust the status and live and work in the US.

I guess my question is can i stay here in the US past my 180 grace

days as long as i have submitted my I-485 and other paper work

without

reprocussions?

You may want to check with an attorney but yes I believe that overstays are forgiven when you apply for AOS. Now I think you may not be eligible for AP or Employment Authorization, but again there are people on this forum who know more than I do. Now I have to ask, why didnt you file your AOS earlier before your I-94 expired?

July 24, 2007: Mailed all paperwork to Chicago (Wish us luck)

Aug 31, 2007: Biometrics Appointment

Sep 1, 2007: Received NOA1 (Dated Aug 29)

Nov 25, 2007: Received notice for interview in Baltimore, MD (No touches, nothing online to date)

Jan 22, 2008: Interview in Baltimore, MD. Went well.

Jan 29, 2008: Can finally track I-130 online. Approved.

Jan 31, 2008: Email I-485 "Card production ordered"

Feb 5, 2008: Another email I-485 "Card production ordered"

Feb 7, 2008: Received I-130 approval and I-485 "Welcome to America Letter" in snail mail

Feb 7, 2008: Email I-485 "Approval notice mailed"

Feb 9, 2008: GC in hand....... (Done with USCIS for a few months) YAYY!!!!!!

Oct 22, 2009: Process starts again. Going to mail I-751 to VSC

Jan 26, 2010: Notice of Approval and Card Production for 10-year GC

Feb 3, 2010: 10-Year GC Received

They all should have been filed concurrently, but what's done is done. I believe if you have a copy of the approval notice, you can file the rest of the paperwork from inside the country, but I do recall one person who did the I-130 separately and her case got forwarded to the consulate in her home country, creating a lot of problems. So you may want to see a lawyer on this one.

noa 1: march 2nd, 2007

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

I know i have a lot of questions but you guys have been so great in helping me deal with the stress! and i want to thank you all that replied to my posts. but here is another one

In filling out the I-864 my wife has been a student for the last 3 years and finally got a 'real job' (she would kill me for saying that) and she is now a teacher making more then the 125% of the poverty line. however on her last 3 y ears of tax returns she didn't meet the poverty line requirements. should she get a letter from her employer stating what she makes, the hours she works and her income for the year. we don't want to wait to submit the documents until she files her next tax return. so any ideas?

Another question redarding my I-765:

like i said i have a SS # for work only with INS approval, and while filling out my I-765 i see the question #11 and i have applied before for work authorization, but it was in 1999 and 2000 and the documentation had been destroyed in a previous house fire...how do i account for this missing information?
