I just got married and i want to file my AOS and other paper work. He earned $21,000 last yr according to the tax report and $14,000 in 2013 then 23,000 in 2012. He is the only one in his hose hold and crossed the poverty line in 2014 and 2012 but not 2013. Do I need a joint sponsor or file it like that. We are both students. I don't want any REF.

Thank you

Hi,

Current income is what is important. As long as his current annual income meets the 125% poverty line, then you should be fine.

If you have a Joint Sponsor who clearly meets the poverty line, then it's best to do it this way if possible.

Best of luck
