"Corrected" I-94 now causing questions about what to enter on I-485

Hey all!

My partner entered the US through Houston on a K-1 visa in January. Her I-94 wouldn't automatically update online and so we had to go to a deferred inspection station to get it all fixed (the consulate entered her passport control number as her passport number on her K1 and so thats why it wouldn't update). The officer at the deferred inspection station got everything fixed so she could get an I-94, but now in her I-94 shows her entering the US in February from Hidalgo, TX, with no mention of Houston or the January entry (but the stamp in her passport shows January entry).

On her I-485, should I enter the information that matches with her I-94 (February entry in Hidalgo) or the actual date/location of her initial entry? Also, if we were to put the information in line with the I-94, would it matter that our marriage certificate states we got married Feb 7 (yay!) even though her I-94 now says she entered in mid-Feb?

Thanks a ton for any help or ideas!!!

Hi,

I cannot promise I am correct and maybe someone else out there could tell you if I am not, but I would put the correct information on the form. The actual date that she entered and what not, then attach a sheet of paper explaining what happened and why the dates may appear differently due to the fix for the issue that she encountered.

Congratulations on the marriage!

If I were you, I would go back to the deferred inspection and get everything corrected, and then file.

Otherwise, since a lot of processing is computerized, there is still a potential for mismatch or confusion

situation that can bite you again down the line.

If you simply want to file as is, then definitely attached an explanation letter...but this would be my second choice.

That makes a lot of sense. Should probably try that route out again at least before filing. When we initially went to have our I-94 corrected, the first site we went to said they could not help at all...and the 2nd site it took a few hours for them to figure out why it wouldn't update. What it turns out happened is that the Consulate entered her passport control number as her passport number...which caused the two computer systems (not 100% sure which two the officer was referring to) to not be able to communicate and update her I-94 correctly on the website. The computer accurately has her entry via Houston, but for some reason wouldn't allow it to show up that way on the I-94 :( I reckon I'll try calling them again to see if they have any other information to help, but when we had finally left (he was great, spent way more time with us than we had imagined) he had said that updating the I-94 that way was the only way for it to connect with the computer systems. What a mess! Thankfully it all worked out OK to get her SSN...no clue if those computer systems are connected at all or not as well, but if so maybe we can catch a break! Thanks!
