Submitting my sons birth certificate..?

I wasn't sure if I should post this here or in the "major family changes" section so if this isn't a good place I apologize!

but my question is.. When I filed my I751 I was pregnant therefore couldn't list any children on the form, my son is now 9 months old and we received his ssn and birth certificate a month or so ago, do I need to notify USCIS of this? (I know most people will tell me to send it in because it will help my case but I believe it will only complicate it due my circumstances) I have no problem submitting it if I have to but if I can avoid bringing that into my I751 case I would like to as it really has minimal connection to the marriage I entered with my ex husband and I was under the impression thats what uscis are primarily interested in.

I would say your form was truthful on the day you submitted it. Should you get an RFE for more evidence, then you have something additional to send.

I received a RFE but it was only asking for my divorce papers not additional evidence, I debated submitting it then but they didn't ask for it so in the end I just followed the request to the letter. My only worry is getting to my interview and having to explain why I didn't tell them my ex husband is on my sons birth certificate since he isn't the father or if I would be better to submit it before hand so it looks like I'm not trying to hide things from them

Oh I didn't know your whole story. Agree, nothing to do with former spouse. And it would be false really, to pass the child off as evidence of a relationship with him. So why would anybody need to see the birth certificate? Those are for evidence of relationship. The child is the next chapter in your life. Why would you need to show photos or anything joint with a new relationship, including a child? I don't see where it would apply.

I don't want to be hurtful in any way but if I understand correctly your EX-husband is listed as the child's father on the birth certificate even though he is not? Does this mean you had the child with another man? If yes, then this seems like evidence that would hurt your application since the perception could be that you were not in a bona fide relationship with your husband if after being married for such a short time you were already having a relationship with someone else. Again, I'm not intending to be hurtful in any way and if I'm missing something here I apologize but you are asking for help and I'm trying to assist based on what I can see. I would think the birth certificate could play one of two roles:

1. It shows that you truly believed your relationship with your ex-husband to be the real deal and you were planning to raise a child together even though it wasn't his?

2. The question of the child's parentage comes up and you are called out based on it. But I don't see how they could know that. And like you said, you were only pregnant at the time of application and did not yet have in-hand your child's birth certificate.

I would just continue on with what you have and deal with any further requests one at at time as they come up. Good luck!

oh I understand completely. I've become pretty thick skinned when it comes down to explaining the situation with my son..as you can imagine..

due to Louisiana state law my ex husband had to be listed as the legal father on my sons birth certificate because we had to be divorced for a period of 1 year in order for the biological father to submit a paternity affidavit to have it changed since my husband was out of state at the time of birth (even though we had been legally separated for a year) and then my divorce took 2 years to go through because my ex husband refused to disclose his location so I currently have 300 and 50 some days until I can legal fix the issue.. I wasn't with my ex husband when I became pregnant nor when the child was born and he has no connections or rights over the child but the state forced his name on the birth certificate which was my only worry as legally the government think he is the father even though it is evident to everybody that he is not.. I know uscis will look harder upon me for having a child with someone else while removing my conditions but I didn't want to be penalized for having what is technically "inaccurate" paper work due to state regulation.
