Hi,

I'll try to make it short. So, I have my interview date and most of th documents are ready. However, I have a question regarding the I-864.

My husband was doing an MBA last year, so although he did file a Tax Return, our income was lower than the 125%. He graduated last year and since January of this year he has been wiorking on his current job and his annual income is higher than the 125%. The thing is that his Tax Return for the past 3 years will not be enough to prove our income is higher, but his paystubs and letter of employment should be anough to prove income. HOWEVER, the lady who gave me the papers for package 4 at the embassy told me that I would need a joint sponsor since my husband income's was not high enough.

BUT I don't think she understood that he did file taxes and that this years his income is higher than the minimum required. IS IT TRUE WE NEED AN ADDITIONAL SPONSOR? Can't my husband with his current income be the only person signing an Affidavit of Support? I aks this because my father-in-law read the I-864 Form and he found it a little but too demanding and too much responsibility. If it is extremelly necessary he will sign it, but he prefers not to do it and so do we, since my husband has a good source of income.

Any help you can give me on the matter or anyone going (or has gone) through the sama and who can give me a inside perspective would be appreciated :)

Looks like you need a sponsor because your husband's 1040s did not meet the requirement. Do you have money in bank accounts or other assets to fill the gap?

I don't see how they can let you pass by only looking at your husband's current pay stubs.

We have money in our savings account and we have a car, but I don't think it will add to the minimum, it will be below for a couple of thousands. However, if they accept our "current" savings accounts and other assets to meet the minimum, why would they not accept our "current" income? It just does not make any sense to me. It is his current income that will pay our bills and expenses, not his previous year's income.

Well, thank you for your answer :) I will keep trying to understand more about the subject.

Anybody else who knows something else about the topic, please feel free to help me out :)
