My husband and I were just married in August. I made it clear at the border when crossing (from Canada) that we were intending to marry and that I'd be returning to Canada after the honeymoon (which I did). Now my two children and I would like to visit my husband for the holidays (Thanksgiving, Christmas and New Years) and return back in January. The problem is that we have not filed any of the paperwork for the cr1 visas yet (we planned on getting it all together & sending it off while I am there in November). Does anyone know if we will be running into problems at the border since they'll know we are married but haven't begun any legal immigration procedures yet? We want to be completely honest and straightforward but would like a heads-up if there's no way they're going to be allowing us to go. I have a binder with proof of ties, etc but I'm hoping it'll be enough supporting evidence to allow for a visit. Any advice for us??

Well, I'm from Brazil and my wife and I went to visit her parents in September, when we went through immigration I clearly stated I was there to visit my in-laws and that my wife was american. We had already started our immigration process, but I didn't mention that, and the officer didn't ask that either. I don't think you will have problems.

Thank you! I go back and fourth quite frequently and i am always completely honest that it's my fiance we are seeing, so they are aware of the situation... but this is the first time I'm trying since we got married so it's a little nerve-wracking!

I don't think you'll have any issues. You're not required to start immigration proceedings within any time frame of marrying, to my knowledge. As long as CBP doesn't think that you're going to overstay, they're good. I'd say as long as you're honest and just be prepared to show ties to your country just in case :)
